{"data":{"id":"us-ky/krs-161.044","jurisdiction":"us-ky","citation":"KRS 161.044","heading":"Requirements for teachers' aides -- Legal status -- Preference to certified","body":"applicants -- Training.\n(1) The Kentucky Board of Education shall promulgate administrative regulations\ngoverning the qualifications of teachers' aides in the common schools. All teachers'\naides working in kindergarten or with entry level students in primary classes and all\ninstructional teachers' aides initially employed after July 1, 1986, except those with\ncurrent teacher certification, shall have a high school dipl oma or a High School\nEquivalency Diploma.\n(2) \"Noninstructional teacher's aide\" means an adult who works under the direct\nsupervision of the teaching staff in performing noninstructional functions such as\nclerical duties, lunch room duties, leading pupils in recreational activities, aiding the\nschool librarian, preparing and organizing instructional material and equipment and\nmonitoring children during a noninstructional period. Noninstructional teachers'\naides employed on a full -time basis shall possess sk ills necessary to perform their\nduties and shall meet the requirements established in KRS 161.011 and 160.380.\n(3) Within the administrative regulations established by the Kentucky Board of\nEducation, a local district may employ teachers' aides in suppleme ntary\ninstructional and noninstructional activities with pupils. While engaged in an\nassignment as authorized under the administrative regulations, and as directed by\nthe professional administrative and teaching staff, these personnel shall have the\nsame l egal status and protection as a certified teacher in the performance of the\nsame or similar duties.\n(4) Local districts shall give preference to applicants for the position of teacher's aide\nwho have regular or emergency teacher certification.\n(5) Local di stricts shall provide training of the instructional teacher's aide with the\ncertified employee to whom he is assigned.","path":["KRS Chapter 161"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48644","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:09Z","sha256":"d0883616406db57c33ce30139a08a975ea741687a92733244c984821fc1569f1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-161.042","next":"us-ky/krs-161.046"},"notice":"GroundRules: Original legal text.
