{"data":{"id":"us-ky/krs-161.141","jurisdiction":"us-ky","citation":"KRS 161.141","heading":"Participation in retirement systems -- State-sponsored insurance program -","body":"- Appropriations for retirement and insurance -- Sick leave credit --\nRequirements and prohibitions concerning public charter school employees\nand local school boards -- Employees of education service provider.\n(1) As used in this section, \"education service provider,\" \"public charter school,\" \"local\nschool board,\" and \"local school district\" have the same meanings as in KRS\n160.1590.\n(2) (a) Public charter school employ ees shall participate in the Teachers' Retirement\nSystem or the County Employees Retirement System, as determined by their\neligibility for participation in the appropriate system and provided the public\ncharter school satisfies the criteria set by the Inte rnal Revenue Service to\nparticipate in a governmental retirement plan.\n(b) Teachers and other certified personnel shall make any required employee\ncontributions to the Teachers' Retirement System under KRS 161.220 to\n161.716.\n(c) Classified employees shall  make any required employee contributions to the\nCounty Employees Retirement System under KRS 78.510 to 78.852.\n(d) A public charter school shall participate in the state -sponsored health\ninsurance program on the same basis as a local school district pursu ant to\nKRS 18A.225.\n(e) Any state appropriation for retirement, health, or life insurance benefits made\non behalf of a local public employee or a school district employee shall also\nbe made on behalf of a public charter school employee.\n(f) A public charter school shall make any required employer contributions to the\nTeachers' Retirement System under KRS 161.220 to 161.716 and the County\nEmployees Retirement System under KRS 78.510 to 78.852 in the same\nmanner as local school districts.\n(g) For the purposes  of calculating sick leave credit under KRS 161.220 to\n161.716, teachers and other certified personnel of a public charter school shall\nnot accumulate more days of sick leave during their employment with the\npublic charter school than they would have other wise accumulated as a\ncertified employee of the school district of location.\n(3) (a) A public charter school employee shall not be required to be a member of any\ncollective bargaining agreement.\n(b) A public charter school employee who enters into any coll ective bargaining\nunit must do so as a separate unit from the local school district.\n(4) A local school board shall not require any employee of the local school district to be\nemployed in a public charter school or any student enrolled in the school distri ct to\nattend a public charter school.\n(5) A local school board shall not harass, threaten, discipline, discharge, retaliate, or in\nany manner discriminate against any district employee involved directly or\nindirectly with an application to establish a public charter school.\n(6) An employee of an education service provider shall not be considered a public\ncharter school employee, but shall meet the same certification and background\ncheck requirements otherwise required of a public charter school employee.","path":["KRS Chapter 161"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53125","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:10Z","sha256":"fba767a986d33a79739f961aa4cf37338538ba0383426c0c0c587c1a8e4d3c5b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-161.140","next":"us-ky/krs-161.145"},"notice":"GroundRules: Original legal text.
