{"data":{"id":"us-ky/krs-161.175","jurisdiction":"us-ky","citation":"KRS 161.175","heading":"Teachers involved in illegal use of controlled substances.","body":"(1) Notwithstanding any provision of the Kentucky Revised Statutes to the contrary, a\nteacher who has been reprimanded or otherwise disciplined by the teacher's\nemployer because the teacher engaged in misconduct involving the illegal use of\ncontrolled substanc es shall, as a condition of retaining employment, submit to\nrandom or periodic drug testing in accordance with administrative regulations\npromulgated by the Kentucky Board of Education for a period not to exceed twelve\n(12) months from the date such reprimand or disciplinary action occurred.\n(2) Notwithstanding any provision of the Kentucky Revised Statutes to the contrary, a\nteacher whose certificate has been suspended or revoked by the Education\nProfessional Standards Board because the teacher engaged in misconduct involving\nthe illegal use of controlled substances shall, as a condition of reinstatement or\nreissuance of the certificate, submit to drug testing in accordance with\nadministrative regulations promulgated by the Education Professional Standards\nBoard.\n(3) No teacher may be subject to drug testing under this section unless and until it has\nbeen determined in an administrative or judicial proceeding that the teacher engaged\nin misconduct involving the illegal use of controlled substances.\n(4) For purposes of this section, the term \"teacher\" shall mean any person for whom\ncertification is required as a basis for employment in the public schools of the\nCommonwealth.\n(5) Nothing in this section shall be interpreted or construed to limit the authority o f the\nEducation Professional Standards Board to impose or require additional conditions\nfor the reissuance or reinstatement of a certificate.\n(6) The administrative regulations promulgated pursuant to this section shall contain\nprovisions that ensure due process under the law.","path":["KRS Chapter 161"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=3888","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:10Z","sha256":"7ec0fef28d64d152326f509f15c0c837a7a8372fdc155650b4a6ebcd8c782cee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-161.170","next":"us-ky/krs-161.180"},"notice":"GroundRules: Original legal text.
