{"data":{"id":"us-ky/krs-161.522","jurisdiction":"us-ky","citation":"KRS 161.522","heading":"Survivors of certain members retired for disability may elect annuity.","body":"Upon the death of a member retired for disability who had a minimum of twenty -seven\n(27) years of service at the time of death, except as provided in KRS 161.661(6), the\nspouse, if named as the primary beneficiary of the member's account, shall be entitled  to\nelect, in lieu of a refund of the member's account, an annuity actuarially equivalent to the\nannuity that would have been paid to the deceased member had retirement for service\nbeen effective on the day immediately preceding the member's death. This option shall be\navailable only during the entitlement period described under KRS 161.661(3) and (4)\nprior to the recalculation of the member's disability allowance under KRS 161.661(5). In\nselecting this right, the spouse shall be limited to selecting an opt ion providing a straight\nlife annuity with refundable balance or a term certain option. There shall be a monthly\nminimum allowance of three hundred dollars ($300) as the basic straight life annuity.\nThis section applies to surviving spouses of members who were receiving benefit\npayments under KRS 161.520 as of June 30, 1988, and to surviving spouses of members\nwho die on or after July 1, 1984, except that the member shall have been retired for\ndisability with a minimum of thirty (30) years of service if eit her of these two (2)\nconditions were met prior to July 1, 1990.","path":["KRS Chapter 161"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51808","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:10Z","sha256":"998237bc0027406abe72dc1d0f69d0ec8c5ab8b7ff11a5673d04aaed03d62b96","source_id":"us-ky","stale":false,"prev":"us-ky/krs-161.520","next":"us-ky/krs-161.525"},"notice":"GroundRules: Original legal text.
