{"data":{"id":"us-ky/krs-161.623","jurisdiction":"us-ky","citation":"KRS 161.623","heading":"Use of unused sick-leave days to determine service credit -- Applicability to","body":"individuals becoming members on or after July 1, 2008 -- Maximum amount.\n(1) Effective July 1, 1982, and thereafter, a district board of education or other\nemployer of members of the Teachers' Retirement System may compensate, at the\ntime of retirement for service, an active contributing member for unused sick -leave\ndays in accordance with this section.\n(2) Upon the member's application for service retirement, the em ployer shall certify the\nretiring member's unused accumulated sick-leave balance to the board of trustees of\nthe Kentucky Teachers' Retirement System. The member's sick -leave balance,\nexpressed in days, shall be divided by one hundred eighty -five (185) day s to\ndetermine the amount of service credit that may be considered for addition to the\nmember's retirement account for the purpose of determining the retirement\nallowance under KRS 161.620. Notwithstanding any statute to the contrary, sick -\nleave credit tha t is accredited under this section or by one (1) of the other state -\nadministered retirement systems shall not be used for the purpose of determining\nwhether the member is eligible to receive a retirement allowance from the Kentucky\nTeachers' Retirement System.\n(3) The board shall compute the cost to the retirement system of the sick -leave credit\nfor each retiring member and shall bill the last employer of the retiring member for\nsuch cost. The employer shall pay the cost of such service credit to the retire ment\nsystem within fifteen (15) days after receiving notification of the cost from the\nboard.\n(4) Retiring members who receive service credit under this section shall not be eligible\nto receive compensation for accrued sick leave under KRS 161.155(10) or any other\nstatutory provision.\n(5) Employer participation is optional and the employer may opt to purchase less\nservice credit than the member is eligible to receive provided the same percentage\nof reduction is made applicable to all retiring members of the  employer during a\nschool fiscal year.\n(6) The board of trustees shall formulate and adopt necessary rules and regulations for\nthe administration of the foregoing provisions.\n(7) Payments to the retirement system for service credit obtained under this sect ion or\nfor compensation credit obtained under KRS 161.155(10) shall be based on the full\nactuarial cost as defined in KRS 161.220(22).\n(8) For an individual who becomes a member on or after July 1, 2008, the maximum\namount of unused accumulated sick leave that may be considered for addition to the\nmember's retirement account for purposes of determining the retirement allowance\nunder KRS 161.620 shall not exceed three hundred (300) days.","path":["KRS Chapter 161"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51823","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:11Z","sha256":"147c5336c734fb9cd8ac8f40d898d8bce0e7fedc184071e3f2f5d4eb73f1d070","source_id":"us-ky","stale":false,"prev":"us-ky/krs-161.620","next":"us-ky/krs-161.624"},"notice":"GroundRules: Original legal text.
