{"data":{"id":"us-ky/krs-161.662","jurisdiction":"us-ky","citation":"KRS 161.662","heading":"Status of disabled teachers and superintendents.","body":"(1) Teachers and superintendents with continuing status who retire because of disability\nshall, notwithstanding provisions of KRS 161.720 to 161.810 to the contrary, retain\ncontinuing status in the school district from which they retired for twenty -four (24)\ncalendar months from the date of retirement, if the teacher or superintendent:\n(a) Is approved for disability retirement under the provisions of KRS 161.661, or\n(b) Is approved for disability retirement but elects to have benefits calculated on\nthe service retirement formula under the provisions of KRS 161.661, or\n(c) Is disqualified from receiving disability retirement benefits by KRS\n161.661(2) but is otherwise eligible for disability retirement under the\nremaining provisions of KRS 161.661.\n(2) (a) If the superintendent recovers from disability and presents written notice of\nsuch recovery, supported by the statement of a licensed physician, to the\nemploying board of education within the twenty -four (24) calendar month\nperiod but not later than April 15 prior to the beginning of the school term, the\nboard of education shall reinstate the superintendent to active continuing\nstatus at the beginning of the school term. If notice of recovery from disability\nis not presented to the employing board of education wi thin the twenty -four\n(24) calendar month period, or if the superintendent states to the board, in a\nverified document, prior to expiration of the twenty -four (24) calendar month\nperiod that he or she will not return to employment in the school system, the\ncontinuing service contract of the superintendent shall terminate as by\nretirement under the provisions of KRS 161.661.\n(b) If the teacher recovers from disability and presents written notice of such\nrecovery, supported by the statement of a licensed physi cian, to the\nsuperintendent within the twenty-four (24) calendar month period but not later\nthan April 15 prior to the beginning of the school term, the superintendent\nshall reinstate the teacher to active continuing status at the beginning of the\nschool t erm. If notice of recovery from disability is not presented to the\nsuperintendent within the twenty -four (24) calendar month period, or if the\nteacher states to the superintendent, in a verified document, prior to expiration\nof the twenty-four (24) calendar month period that he or she will not return to\nemployment in the school system, the continuing service contract of the\nteacher shall terminate as by retirement under the provisions of KRS 161.661.\n(3) Retirement because of disability under this section s hall not be cause for\ntermination of the contract of a teacher or superintendent under KRS 161.790\nduring the twenty -four (24) calendar month period described in this section. A\nteacher or superintendent who applies for disability retirement under the prov isions\nof KRS 161.661 shall retain continuing service status during the period of time the\napplication for disability retirement is being processed. If the application is not\napproved, the teacher or superintendent may return to the contract, employment, o r\nleave status held prior to submission of the application.\n(4) (a) If the superintendent recovers from the disability and presents written notice\nof such recovery, supported by the statement of a licensed physician, to the\nemploying board of education wit hin twenty-five (25) through forty -two (42)\nmonths from the date of retirement, the board shall give priority consideration\nto reemployment of the superintendent for the first available position for\nwhich the superintendent is qualified and certified.\n(b) If the teacher recovers from the disability and presents written notice of such\nrecovery, supported by the statement of a licensed physician, to the\nsuperintendent within twenty -five (25) through forty -two (42) months from\nthe date of retirement, the super intendent shall give priority consideration to\nreemployment of the teacher for the first available position for which the\nteacher is qualified and certified.","path":["KRS Chapter 161"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=3977","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:11Z","sha256":"67978586428169ecb73fa94e3490682f425d07c86adbe5f4de6d66bdb355785e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-161.661","next":"us-ky/krs-161.663"},"notice":"GroundRules: Original legal text.
