{"data":{"id":"us-ky/krs-161.770","jurisdiction":"us-ky","citation":"KRS 161.770","heading":"Leaves of absence.","body":"(1) Upon written request of a teacher or superintendent, a board of education may grant\na leave of absence for a period of not more than two (2) consecutive school years\nfor educational or professional purposes, and shall grant such leave where illness,\nmaternity, adoption of a child or children, or other disability is the reason for the\nrequest. Upon subsequent request, such leave may be renewed by the board. A\nboard of education may pay a sum of money equivalent to all or any portion of\nsalary to a teacher or  superintendent who has been granted leave for educational or\nprofessional purposes if the person taking said leave agrees in writing to return to\nemployment with the board for no less than two (2) years.\n(2) Without request, a board of education may grant  leave of absence and renewals\nthereof to any teacher or superintendent because of physical or mental disability, but\nsuch teacher or superintendent shall have the right to a hearing and appeal on such\nunrequested leave of absence or its renewal in accorda nce with the provisions for\nhearing and appeal in KRS 161.790.\n(3) Any action taken under subsection (1) or (2) of this section shall not violate the\nAmericans with Disabilities Act of 1990, the Health Insurance Portability and\nAccountability Act of 1996, or any other applicable federal law. A board of\neducation:\n(a) May only request medical information necessary to decide whether to grant a\nleave of absence;\n(b) Shall not request or retain unnecessary medical information; and\n(c) Shall not disclose any med ical information received, except as permitted by\nstate and federal law.\n(4) Upon the return to service of a teacher or superintendent at the expiration of a leave\nof absence, he shall resume the contract status which he held prior to such leave.\n(5) Payments to any teacher or superintendent under this section by a local district are\nintended and presumed to be for and in consideration of services rendered and for\nthe benefit of the common schools and such payments do not affect the eligibility of\nany school district to share in the distribution of funds from the public school funds\nas established in KRS Chapter 157.","path":["KRS Chapter 161"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48639","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:11Z","sha256":"f165f6820cd04d95d7f8fa02f5f97f6877570f3790a66cdf340bc11bbb9fa5e9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-161.765","next":"us-ky/krs-161.780"},"notice":"GroundRules: Original legal text.
