{"data":{"id":"us-ky/krs-161.795","jurisdiction":"us-ky","citation":"KRS 161.795","heading":"Investigation of and records that school employee acted improperly","body":"relating to statewide assessment program -- Certain records to be expunged.\n(1) In cases where a decision or judgment was tendered in an administrative or judicial\nproceeding before Ju ly 15, 1998, in an investigation of allegations that a teacher,\nadministrator, or other school employee acted improperly relating to the statewide\nassessment program required by KRS 158.6453, all references relating to the\ninvestigation, findings, and disc iplinary actions shall be expunged from the\nindividual's personnel file by the local school district, and the Kentucky Department\nof Education and the Education Professional Standards Board shall expunge any\nreferences to the investigation and findings in all agency files. This shall apply to all\naffected persons found not guilty of the allegations.\n(2) After July 15, 1998, allegations that a teacher, administrator, or other school\nemployee has acted improperly relating to the statewide assessment program\nrequired by KRS 158.6453 shall be investigated. If the individual is found not guilty\nof the allegations, all references to the charges shall be immediately expunged from\nthe individual's personnel file in the local school district, and the Kentucky\nDepartment of Education and the Education Professional Standards Board shall\nexpunge all references to the investigation from all agency files.","path":["KRS Chapter 161"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=4001","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:11Z","sha256":"f764727357585f745824f8b24cf4c6ed81fee324c644544440b7bd8ec1abc5e8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-161.790","next":"us-ky/krs-161.800"},"notice":"GroundRules: Original legal text.
