{"data":{"id":"us-ky/krs-164.0402","jurisdiction":"us-ky","citation":"KRS 164.0402","heading":"Legislative intent -- Kentucky healthcare workforce investment fund --","body":"Administrative regulations.\n(1) It is the intent of the General Assembly to address Kentucky's persistent shortage of\na broad spectrum of certified and licensed healthcare pr ofessionals, including\nnurses, mental health professionals, and emergency medical services professionals,\nby incentivizing collaboration between healthcare programs, healthcare industry\npartners, and the Commonwealth to grow and strengthen the education an d training\npipeline of healthcare professionals within Kentucky to better serve patients across\nthe Commonwealth by:\n(a) Improving the ability of a broad variety of Kentucky's healthcare programs to\nmeet the workforce demands and capacity of the Commonweal th, including\nthe workforce demands of historically underserved counties;\n(b) Raising awareness of and interest in a broad variety of healthcare occupations\nand reducing the barriers of access to the healthcare programs necessary to\npursue these occupations, including financial barriers;\n(c) Increasing knowledge and awareness of opportunities in high -need areas of\nhealthcare, including but not limited to geriatrics and neurology;\n(d) Improving pathways between high school career and technical programs and\nother healthcare programs; and\n(e) Developing strategies for healthcare organizations to support career growth\nand development for their employees.\n(2) There is hereby created the Kentucky healthcare workforce investment fund to be\nadministered by the council for the purpose of funding:\n(a) Public and private partnerships to provide healthcare training scholarships in\naccordance with KRS 164.0403 to reduce the financial barriers of Kentucky\nresidents seeking high-demand eligible healthcare credentials;\n(b) Healthcare program incentives in accordance with KRS 164.0404 to reward\nperformance and excellence among the Commonwealth's healthcare\nprograms; and\n(c) The council's administrative, research, consulting, fundraising, planning, and\nanalysis costs of KRS 164.0401 to 164.0407.\n(3) (a) It is the intent of the General Assembly to encourage private financial and\nphilanthropic support of the Kentucky healthcare workforce investment fund,\nas the healthcare industry directly benefits from a well -trained workforce\ncapable of meeting its employ ment needs and the needs of patients. To the\nextent allowed by applicable laws, the fund may directly accept gifts, grants,\nor donations subject to restrictions imposed by a grantor.\n(b) Notwithstanding KRS 45.229, any moneys appropriated to the fund by th e\nGeneral Assembly remaining in the fund at the end of any fiscal year prior to\nthe 2029-2030 fiscal year shall not lapse.\n(c) Any moneys appropriated to the fund by the General Assembly remaining in\nthe fund at the end of the 2029 -2030 fiscal year shall b e forfeited and shall\nlapse to the general fund.\n(d) Any moneys contributed by grantors remaining in the fund at the end of the\n2029-2030 fiscal year shall be returned to each grantor proportionally based\non the amount donated by the grantor in relation to  the total amount donated\nby all grantors.\n(4) Subject to available funds, the Kentucky healthcare workforce investment fund\nshall consist of any:\n(a) Appropriations designated for the fund;\n(b) Funds, grants, and receipts from the council's fundraising ac tivities on behalf\nof the fund; and\n(c) Other moneys made available for the purposes of the fund.\n(5) Any interest earnings of the fund shall become a part of the fund and shall lapse\nonly as provided in subsection (3) of this section, except that interest  on moneys\ncontributed by a grantor shall not lapse. Moneys in the fund are hereby appropriated\nfor the purposes set forth in this section.\n(6) The portion of the fund expended towards the council's costs of administering KRS\n164.0401 to 164.0407 shall not exceed four percent (4%) of all gross moneys in the\nfund or one million five hundred thousand dollars ($1,500,000) annually, whichever\nis less.\n(7) (a) The council shall promulgate administrative regulations by July 1, 2023, in\naccordance with this subsec tion and KRS Chapter 13A to administer KRS\n164.0401 to 164.0407.\n(b) At least thirty (30) days before filing an administrative regulation with the\nregulations compiler, the council shall first submit the draft administrative\nregulation, a detailed implemen tation plan, and other documents required to\nbe filed by KRS Chapter 13A to the members of the Interim Joint Committee\non Education and the Interim Joint Committee on Health Services for review\nand comment.\n(c) The council shall consider any comments and r ecommendations provided by\nthe members of the Interim Joint Committee on Education and the Interim\nJoint Committee on Health Services before filing the administrative\nregulation.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53470","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:14Z","sha256":"95c0ac48789513db301e7723adee1ede6790c7e3a59e3a11970a6ea0312d1e6b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.0401","next":"us-ky/krs-164.0403"},"notice":"GroundRules: Original legal text.
