{"data":{"id":"us-ky/krs-164.0404","jurisdiction":"us-ky","citation":"KRS 164.0404","heading":"Healthcare program incentive -- Administrative regulations -- Incentive","body":"application process and requirements.\n(1) The council shall reserve up to thirty -five percent (35%) of all net moneys in the\nKentucky healthcare workforce investment fund fo r healthcare program incentives\nto reward performance and excellence among eligible healthcare programs. Any\nappropriation applied towards the amount of a healthcare program incentive award\nshall be matched, at least dollar for dollar, with moneys deposited to the fund by the\nhealthcare partner.\n(2) The council shall promulgate administrative regulations to establish criteria for\nissuing healthcare program incentives. The criteria shall consider the following\nfactors:\n(a) The workforce demands and capacity for a specific eligible healthcare\ncredential;\n(b) The workforce demands and capacity for a specific eligible healthcare\ncredential within historically underserved counties;\n(c) The percentage of increase over a baseline standard in the number of students\ncompleting the healthcare program;\n(d) The passage rate and first -time passage rate of graduates of the healthcare\nprogram on the healthcare credential examination; and\n(e) Any other objective factors determined by the council to be relevant to the\nevaluation of the performance and excellence of the healthcare programs and\nthe ability of the healthcare programs to meet the workforce needs of the\ncommunities they serve.\n(3) (a) The council, or its designee, shall solicit, accept, and review applications for\nhealthcare program incentives by healthcare programs located in Kentucky.\nThe council, or its designee, shall select the healthcare programs to receive\nhealthcare program incentives and the amount thereof based on the criteria\nestablished by this section, administrative regulations, and a grantor of\ndedicated funds, if applicable.\n(b) A healthcare partner that is the grantor of dedicated funds may reserve the\nright to require the council, or its designee, to collaborate with the healthcare\npartner in fulfilling the duties assigned under paragraph (a) of this subsection\nfor any healthcare program incentive funded by the grantor's dedicated funds,\nexcept an incentive shall not be:\n1. Awarded to a healthcare program that has gifted, granted, or donated\nany moneys to the fund that are dedicated funds reserved for the purpose\nof issuing incentives under this section; or\n2. Restricted to a specific healthcare program or pursuant to criteria which\nwould have the impact of effectively excluding all but a single\nhealthcare program from qualification.\n(c) Decisions of the council, or its designee, in these matters shall be final.\n(4) The council shall require the healthcare program to submit proof that the entire\namount of the incentive is invested in the continued excellence of the program\nawarded by funding the:\n(a) Education, recruitment, and tra ining of the healthcare program's faculty and\nstaff; or\n(b) Maintenance and acquisition of medical equipment utilized by the healthcare\nprogram.\nA healthcare program that fails to submit the proof required by the council shall\nreturn the entire amount of the incentive to the Kentucky healthcare workforce\ninvestment fund.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53472","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:14Z","sha256":"5d6c9d54ec14c86057ef8c6eeb65c60dd8f61ada6b043287b2c99f919caa351a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.0403","next":"us-ky/krs-164.0405"},"notice":"GroundRules: Original legal text.
