{"data":{"id":"us-ky/krs-164.2813","jurisdiction":"us-ky","citation":"KRS 164.2813","heading":"Postsecondary education institution -- Designation of teams -- Eligibility","body":"to play.\n(1) (a) A public postsecondary education institution or private postsecondary\neducation institution that is a member of a national intercollegiate athletic\nassociation shall designate all intercollegiate and intramural athletic teams,\nactivities, sports, and events that are sponsored or authorized by the institution\nas one (1) of the following categories:\n1. \"Men's\";\n2. \"Coed\"; or\n3. \"Women's.\"\n(b) 1. A public  postsecondary education institution or private postsecondary\neducation institution that is a member of a national intercollegiate\nathletic association shall prohibit a member of the male sex from\ncompeting in any intercollegiate or intramural athletic tea m, activity,\nsport, or event designated as \"women's.\"\n2. Nothing in this section shall be construed to restrict the eligibility of any\nstudent to participate in an athletic activity or sport designated as\n\"men's\" or \"coed.\"\n(2) The sex of a student for the  purpose of determining eligibility to participate in an\nathletic activity or sport or to use an athletic facility designated for the exclusive use\nof a single sex shall be determined by:\n(a) A student's biological sex as indicated on the student's origina l, unedited birth\ncertificate issued at the time of birth; or\n(b) An affidavit signed and sworn to by a physician, physician assistant, advanced\npractice registered nurse, or chiropractor under penalty of perjury establishing\nthe student's biological sex at the time of birth.\n(3) A government entity, licensing or accrediting organization, or athletic association or\norganization shall not entertain a complaint, open an investigation, or take any other\nadverse action against a postsecondary education institut ion for maintaining a\nseparate interscholastic or intramural athletic team, activity, sport, or event for\nmembers of the female sex.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53060","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:14Z","sha256":"c088ab4b3b68cb3671f7975d34bbf111f64e6dee821bcc0461b7b5ced42bb9f6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.281","next":"us-ky/krs-164.2815"},"notice":"GroundRules: Original legal text.
