{"data":{"id":"us-ky/krs-164.283","jurisdiction":"us-ky","citation":"KRS 164.283","heading":"Student academic records confidential -- Exceptions.","body":"(1) As used in this section unless the context otherwise requires:\n(a) \"Academic\" means a student's official record of academic performance,\nincluding, but not limited to transcript of grades or other action taken by the\ninstitution directly related to academi c performance. The term \"academic\"\ndoes not include any nonacademically-related action the institution may take.\n(b) \"Universities and colleges\" means all state supported postsecondary\neducational institutions in Kentucky.\n(c) \"Institution\" means all publi c supported institutions of higher learning in\nKentucky.\n(2) All student academic records shall be confidential and shall not require a student's\nSocial Security number to identify the student, with the exception of the exemptions\nstated in subsections (3)  to (9) of this section, and shall not be released by any\npublic supported institution of higher education in Kentucky, to any person,\norganization, institution, group, or agency, except with the express consent of the\nindividual student. This confidentiality shall apply only to student academic records,\nincluding, but not limited to, official transcript of grades.\n(3) All student academic records shall be made available upon request to any agency of\nthe federal or state government for the purpose of determ ining a student's eligibility\nfor military service and shall include making such records available to local draft\nboards. This authority shall be limited only to determining the student's eligibility\nfor military service and shall not be extended, except w ith the individual student's\nconsent as specified in subsection (2) of this section.\n(4) Any institution may provide the legal parents of any student under twenty -one (21)\nyears of age with a copy of the student's academic record.\n(5) All student academic records shall be made available to any federal, state, or local\nlaw enforcement agency, the Department of Juvenile Justice, and any court of law\nupon written request.\n(6) All student academic records shall be made available upon request to any grantor of\nscholarships or loans based upon the maintenance of a satisfactory level of\nscholarship, but shall be for the official use of the grantors only.\n(7) All student academic records shall be made available upon request to a public or\nprivate junior college from  which the individual student was graduated or to a\npublic or private secondary school from which the individual student was\ngraduated.\n(8) All student academic records shall be made available upon request to the Council\non Postsecondary Education for professional academic research.\n(9) All student academic records shall be made available upon request to any official of\nthe university or college in which the student is enrolled who is directly concerned\nwith the student's academic progress. This authority s hall include but is not limited\nto the individual student's academic adviser.\n(10) This section shall be applicable to all academic records maintained by all public\npostsecondary educational institutions in Kentucky.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=4231","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:14Z","sha256":"7f30e715f25d59bb78f1d3388139e2977cb486e1d9872950f2d891f81b57fd17","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.282","next":"us-ky/krs-164.284"},"notice":"GroundRules: Original legal text.
