{"data":{"id":"us-ky/krs-164.2871","jurisdiction":"us-ky","citation":"KRS 164.2871","heading":"Liability insurance for governing board members, faculty, and staff --","body":"Retirement annuity allowances exemption -- Taxability after December 31,\n1997 -- Purchase of insurance not waiver of immunity -- Self-insured employer\ngroup health plan -- Special enrollment period for pregnancy.\n(Effective until January 1, 2027)\n(1) The governing board of each state postsecondary educational institution is\nauthorized to purchase liability insurance for the protection of the individual\nmembers of the governing board, faculty, and staff of such institutions from liability\nfor acts and omissions committed in the course and scope of the individual's\nemployment or service. Each institution may purchase the type and amount of\nliability coverage deemed to best serve the interest of such institution.\n(2) All retirement annuity allowances accrued or accruing to any employee of a state\npostsecondary educational institution through a retirement program sponsored by\nthe state postsecondary educational inst itution are hereby exempt from any state,\ncounty, or municipal tax, and shall not be subject to execution, attachment,\ngarnishment, or any other process whatsoever, nor shall any assignment thereof be\nenforceable in any court. Except retirement benefits ac crued or accruing to any\nemployee of a state postsecondary educational institution through a retirement\nprogram sponsored by the state postsecondary educational institution on or after\nJanuary 1, 1998, shall be subject to the tax imposed by KRS 141.020, to  the extent\nprovided in KRS 141.010 and 141.0215.\n(3) Except as provided in KRS Chapter 44, the purchase of liability insurance for\nmembers of governing boards, faculty and staff of institutions of higher education\nin this state shall not be construed to b e a waiver of sovereign immunity or any\nother immunity or privilege.\n(4) The governing board of each state postsecondary education institution is authorized\nto provide a self -insured employer group health plan to its employees, which plan\nshall:\n(a) Conform to the requirements of Subtitle 32 of KRS Chapter 304; and\n(b) Except as provided in subsection (5) of this section, be exempt from\nconformity with Subtitle 17A of KRS Chapter 304.\n(5) A self-insured employer group health plan provided by the governing b oard of a\nstate postsecondary education institution to its employees shall comply with:\n(a) KRS 304.17A-129;\n(b) KRS 304.17A-133;\n(c) KRS 304.17A-145;\n(d) KRS 304.17A-163 and 304.17A-1631;\n(e) KRS 304.17A-261;\n(f) KRS 304.17A-262;\n(g) KRS 304.17A-264; and\n(h) KRS 304.17A-265.\n(6) (a) A self-insured employer group health plan provided by the governing board of\na state postsecondary education institution to its employees shall provide a\nspecial enrollment period to pregnant women who are eligible for coverage in\naccordance with the requirements set forth in KRS 304.17-182.\n(b) The governing board of a state postsecondary education institution shall, at or\nbefore the time an employee is initially offered the opportunity to enroll in the\nplan or coverage, provide the employee a notice of the special enrollment\nrights under this subsection.\nEffective: January 1, 2025","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55803","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:15Z","sha256":"e239838ad0d06a0dd50cc4e35a9dc4c4d947224b6f6df5922455a7d831982561","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.287","next":"us-ky/krs-164.288"},"notice":"GroundRules: Original legal text.
