{"data":{"id":"us-ky/krs-164.476","jurisdiction":"us-ky","citation":"KRS 164.476","heading":"Lung cancer research fund -- Consortium between Universities of","body":"Kentucky and Louisville to be known as the Governance Board of the Lung\nCancer Research Project -- Annual audit.\n(1) The \"Lung Cancer Research Fund\" is created and shall receive fund s each year\nfrom the Kentucky health care improvement fund in the amount specified in KRS\n304.17B-003(5)(b). The lung cancer research fund shall be used to finance the Lung\nCancer Research Project described in subsection (5) of this section. No revenues\nfrom the lung cancer research fund shall be allocated until the board has adopted the\nstrategic plan described in subsections (5) and (6) of this section.\n(2) A research consortium between the University of Kentucky and the University of\nLouisville is create d and shall be known as the Governance Board of the Lung\nCancer Research Project. The consortium shall be attached to the Council on\nPostsecondary Education for administrative purposes.\n(3) The board shall consist of nine (9) members appointed by the Governor as follows:\n(a) Two (2) members shall be from the faculty of the School of Medicine at the\nUniversity of Kentucky;\n(b) Two (2) members shall be from the faculty of the School of Medicine at the\nUniversity of Louisville;\n(c) Two (2) members shall be from the Council on Postsecondary Education; and\n(d) Three (3) members shall be from the state at large, one (1) of whom shall be\nappointed chair by the Governor.\n(4) Except as provided in paragraphs (a) to (d) of this subsection, the terms of the\nmembers sha ll be for four (4) years and until their successors are appointed and\nconfirmed. A vacancy on the board shall be filled for the remainder of the\nunexpired term in the same manner as the original appointment. Members may be\nreappointed. The initial appointments shall be for staggered terms, as follows:\n(a) Two (2) members shall be appointed for one (1) year;\n(b) Two (2) members shall be appointed for two (2) years;\n(c) Two (2) members shall be appointed for three (3) years; and\n(d) Three (3) members shall be appointed for four (4) years.\n(5) The Governance Board of the Lung Cancer Research Project shall develop and\noversee the implementation of a twenty (20) year strateg ic plan that utilizes the\nresources of both the University of Louisville and the University of Kentucky in\nestablishing the Lung Cancer Research Project. The Lung Cancer Research Project\nshall be a joint program to:\n(a) Develop an expertise in the area of lung cancer research with an immediate\nfocus on early detection and epidemiology and with an ultimate goal of\neradication of lung cancer;\n(b) Establish a statewide clinical trial network to make university -based clinical\ntrials available to the community p hysician in order to bring the most\ninnovative cancer treatments to all Kentuckians in need of these treatments;\n(c) Leverage the resources earmarked for the Lung Cancer Research Project\ntoward the certification of the cancer program at the University of K entucky\nand the University of Louisville by the National Cancer Institute as a cancer\ncenter; and\n(d) Undertake other initiatives consistent with the strategic plan.\n(6) The strategic plan shall identify both short -term and long -term goals and the\nappropriate oversights to measure progress toward achievement of those goals; it\nshall be updated every two (2) years.\n(7) The Governance Board of the Lung Cancer Research Project shall submit an annual\nreport to the Governor and the Legislative Research Commissio n by September 1\neach year for the preceding fiscal year, outlining its activities and expenditures.\n(8) The Auditor of Public Accounts, on an annual basis, shall conduct a thorough\nreview of all expenditures from the lung cancer research fund and, if nece ssary in\nthe opinion of the Auditor, the operations of the Lung Cancer Research Project and\nthe lung cancer research fund.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=4296","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:15Z","sha256":"32c3ec75ada4da77e61cecbcf532645e61437e19c52d560803ceaf04f4390e9e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.475","next":"us-ky/krs-164.477"},"notice":"GroundRules: Original legal text.
