{"data":{"id":"us-ky/krs-164.540","jurisdiction":"us-ky","citation":"KRS 164.540","heading":"Council on Postsecondary Education designated agency of state for","body":"purposes of regional compact -- Commonwealth not to maintain educational\ninstitutions that are discriminatory -- Authorized actions on behalf of the\nCommonwealth.\n(1) The Council on Postsecondary Education in Kentucky as defined in KRS 164.011 is\nhereby designated as the agency of the Commonwealth of Kentucky charged with\nthe responsibility and vested with all necessary authority, subject to the conditions\nand restrictions set out in s ubsection (2) of this section, to carry out the obligations,\nparticipate in the planning and negotiations, and administer the rights, benefits, and\nprivileges, devolving upon the Commonwealth of Kentucky and its citizens\npursuant to the regional compact re ferred to in KRS 164.530, and to do all such\nother acts and things as may be necessary or desirable to implement the provisions\nof said regional compact efficiently and impartially for the benefit of all citizens of\nthe Commonwealth.\n(2) In its participati on in the regional compact, or in any other regional plan having a\nsimilar purpose, the Commonwealth of Kentucky shall not erect, acquire, develop,\nor maintain in any manner any educational institution within its borders to which\nany student would be refus ed entrance on the basis of race, national origin, gender,\ncreed, or religion.\n(3) Notwithstanding any other law governing the offering of postsecondary education in\nthe state, the council shall be authorized to take the following actions on behalf of\nthe Commonwealth:\n(a) Enter into the State Authorization Reciprocity Agreement, which establishes\nuniform national standards for interstate offerings of postsecondary distance\neducation and authorizes postsecondary educational institutions meeting those\nstandards located in member states or territories to provide distance education\nto residents of the Commonwealth;\n(b) Serve as the lead or \"portal\" agency on behalf of the Commonwealth's public\nand private postsecondary institutions seeking to offer distance edu cation in\nmember states by:\n1. Managing functional and administrative state responsibilities under the\nState Authorization Reciprocity Agreement; and\n2. Serving as the official contact for other states and students from other\nstates on matters pertaining to the agreement; and\n(c) Promulgate administrative regulations in accordance with KRS Chapter 13A\nto establish procedures for participation by Kentucky postsecondary\ninstitutions in the State Authorization Reciprocity Agreement.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45057","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:16Z","sha256":"a09005cfa397ceb9fed253f29854cd9f08e3f588e516c222aae67f157ff2f124","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.530","next":"us-ky/krs-164.550"},"notice":"GroundRules: Original legal text.
