{"data":{"id":"us-ky/krs-164.5805","jurisdiction":"us-ky","citation":"KRS 164.5805","heading":"Transfer of assets, liabilities, and staff positions of Kentucky Tech System","body":"-- Employee benefits and salaries of transferred employees -- Rules governing\ntransferred employees.\n(1) Effective July 1, 1998, the Kentucky Community and Technical College System\nshall be the legal successor to the postsecondary Kentucky Tech institutions and\ncorresponding administrative units in the former Cabinet for Workforce\nDevelopment and shall assume all assets and liabilities of this system, including\nwithout limitation all obligations, responsibilities, programs, staff, instructional\nsupplies, equipment, real property, facilities, funds, and records. The Finance and\nAdministration Cabinet shall execute the instruments necessary to transfer the real\nproperty relating to the operation of the postsecondary institutions in the Kentucky\nTech System from the former Cabinet for Workforce Development to the Kentucky\nCommunity and Technical College System.\n(a) The staff positions in the former Department for Technical Education and the\nformer Cabinet for Workforce Development whose responsibilities include\nsupport for the postsecondary institutions in the Kentucky Tech System and\nthe school -based positions shall be transferred to the Kentucky Community\nand Technical Col lege System. Selected employees of the Kentucky Tech\nregional offices shall be transferred and reassigned within the Kentucky\nCommunity and Technical College System. Appropriate central office\nfunctions from the Department for Technical Education shall be assigned\nwithin the system to carry out the administrative and support functions with\nthe approval of the board of regents for the Kentucky Community and\nTechnical College System.\n(b) All funds related to the costs of operating the Kentucky Tech postsecond ary\ninstitutions, including the administrative costs, shall be transferred to the\nboard of regents for the Kentucky Community and Technical College System\nfor carrying out the mission of the postsecondary technical institutions and\ncolleges.\n(c) Funds rais ed by a not -for-profit or nonprofit organization for a specific\nprogram or technical institution shall be for the exclusive use of the program\nor that technical institution.\n(d) The following provisions shall apply to the employees who are transferred\nfrom the former Cabinet for Workforce Development to the Kentucky\nCommunity and Technical College System, effective July 1, 1998:\n1. Accumulated sick leave, compensatory time, and annual leave as of June\n30, 1998, shall be transferred with each employee;\n2. Employees who have earned continuing status as defined in KRS\n156.800 and employees who have earned classified status as merit\nsystem employees under KRS Chapter 18A shall be provided the same\nstanding. Those employees who are transferred and are in the proc ess of\nearning continuing status or classified status shall earn their standing\nbased on the rules that were governing them on June 30, 1998, in their\nrespective systems. New employees within the system shall earn status\nbased on the new policies established by the board;\n3. Employees shall transfer into the new system at a salary not less than\ntheir previous salary as of June 30, 1998;\n4. Employees shall be provided retirement plans in the same system where\nthey are currently enrolled: the Kentucky Teacher s' Retirement System\nunder KRS 161.220 or the Kentucky Employees Retirement System\nunder KRS 61.525;\n5. Employees shall be provided a health benefits package that is available\nor equivalent to that provided to other state or university employees; and\n6. Employees shall be provided life insurance coverage and optional\ninsurance or investment programs.\n(e) The board shall adopt rules that are the same as the administrative regulations\nunder KRS Chapter 151B in effect on June 30, 1998, to govern the certified\nand equivalent employees who transfer from the former Cabinet for\nWorkforce Development, except that the rules shall provide that all grievances\nand appeals shall be to the board of regents or to the board's designee. The\nboard shall adopt rules that are t he same as the administrative regulations\nunder KRS Chapter 18A in effect on June 30, 1998, to govern the transferred\nclassified employees, except that the rules shall provide that all grievances and\nappeals shall be to the board of regents or to the board 's designee. A\ntransferred employee shall have the option to elect to participate in the new\nKentucky Community and Technical College personnel system in lieu of the\nrules under which the employee transferred. An employee who elects to accept\nthis option may not return to the previous personnel policy. An employee shall\nhave the right to exercise this option at any time.\n(2) New employees hired after July 1, 1997, in the Kentucky Community and Technical\nCollege System shall be governed by the rules and regulations established by the\nboard, except that no housing allowance shall be provided for the president of the\nKentucky Community and Technical College System.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47325","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:16Z","sha256":"3277f323c4f3698e402de32f497b2719e0e247dc6939f675632a1814c5a74252","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.580","next":"us-ky/krs-164.5807"},"notice":"GroundRules: Original legal text.
