{"data":{"id":"us-ky/krs-164.583","jurisdiction":"us-ky","citation":"KRS 164.583","heading":"Lower division academic courses -- Transfer of credits -- Review of new","body":"program that will require appropriation.\n(1) Each college in the Kentucky Community and Technical College System may offer,\nwithin the two (2) year academic curriculum of  the college, any and all lower\ndivision academic courses offered for undergraduate credit at any and all of the four\n(4) year public colleges and universities.\n(2) All lower division academic courses offered by the KCTCS shall be transferable for\nacademic credit to any and all four (4) year public colleges and universities,\nregardless of the number of academic credits earned by any student at one (1) or\nmore KCTCS colleges.\n(3) This section shall not be construed or interpreted to change, reduce, or otherw ise\naffect the required distribution between lower division and upper division courses\nnow required for matriculation in an undergraduate program at any institution of\nhigher education.\n(4) (a) If the KCTCS seeks to offer a new accredited program which wil l require\ndedicated general fund appropriations for capital or operating expenses\nbeyond the system's regular appropriations, the president shall submit a\nproposal to the board of regents of KCTCS for review and approval. The\nboard's review shall include but not be limited to:\n1. The proposed program's alignment with the mission and goals of the\nsystem;\n2. The statewide or regional need the proposed program seeks to fill and\nhow the system, through the offering of this program, would meet this\nneed;\n3. Student demand for the proposed program;\n4. Employer demand for the proposed program, including any potential\nindustry partners;\n5. Utilization of existing institutional resources to deliver the proposed\nprogram and how the program would complement existing program\nofferings and not shift resources away from those existing programs;\n6. A five (5) year budgetary analysis of the proposed  program, including\nprogram costs, funding sources projected to support the program, and\nthe amount of general fund appropriations needed for capital or\noperating expenses;\n7. The proposed program curriculum;\n8. Any specialized accreditation or licensure requirements for the proposed\nprogram and analysis of how those requirements would be met;\n9. Admission and graduation requirements for the proposed program; and\n10. Administrative oversight to ensure the quality of the proposed program.\n(b) A proposal ap proved by the KCTCS board shall be submitted to the council\nfor consideration in the system's budget request for the next biennial budget in\naccordance with KRS 164.020(10) and 164.7915.\n(5) The Council on Postsecondary Education shall review each proposal  submitted in\naccordance with subsection (4)(b) of this section and shall determine if the proposal\nshould be included in the biennial budget request pursuant to KRS 164.7915.\n(6) If the new accredited program will not require dedicated general fund\nappropriations for capital or operating expenses beyond the system's regular\nappropriations, the KCTCS may proceed with the new program in accordance with\nKRS 164.020(15).","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57979","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:16Z","sha256":"e6a6efad34846a8a5bc20e784d5eca9c04ddcea3581f2eaa226fbdb1e9e1e45a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.582","next":"us-ky/krs-164.5833"},"notice":"GroundRules: Original legal text.
