{"data":{"id":"us-ky/krs-164.591","jurisdiction":"us-ky","citation":"KRS 164.591","heading":"Creation or expansion of college or campus requiring appropriation --","body":"Review by board of regents -- Reports to Legislative Research Commission --\nApproval by General Assembly.\n(1) If the president of the KCTCS determines that there is a neces sity to create or\nexpand any college or campus requiring an appropriation by the General Assembly\ndue to a new accredited program or workforce initiative program proposed in\naccordance with KRS 164.583(4)(a), the president shall:\n(a) Include a plan for rev iew and approval by the KCTCS board of regents for\ninclusion in the biennial budget request pursuant to KRS 164.7915; and\n(b) Not be authorized to move forward to create or expand any college or campus\nunder this subsection unless the General Assembly appr opriates funds and the\ncouncil approves the proposal in accordance with KRS 164.583(5).\n(2) No later than thirty (30) days after approval of the proposed plan by the council, the\nKCTCS shall submit the proposed plan in its entirety and a report on the prop osed\nplan to the Legislative Research Commission for referral to the Interim Joint\nCommittees on Education and Appropriations and Revenue or, when the General\nAssembly is in session, to the Senate Standing Committees on Education and\nAppropriations and Revenue and the House Standing Committees on Postsecondary\nEducation and Appropriations and Revenue, which includes the following as it\nrelates to the proposed plan:\n(a) An accounting of all necessary expenditures by fund source;\n(b) A detailed accounting of all administrative expenses;\n(c) A detailed accounting of all expenses not otherwise classified;\n(d) Identification of any reduction in expenditures;\n(e) An explanation of any new expenses or cost savings expected to be realized\nbased on the plan; and\n(f) An explanation of how the plan aligns with the operational plan of the\nKCTCS and the strategic plan of the council.\n(3) The KCTCS shall submit documentation of capital and operating expenses\nassociated with and specific to the plan with the next biennial budget request.\n(4) Final approval of the proposed plan shall require the president of the KCTCS to\nobtain approval by th e General Assembly by means of an act or joint resolution\nexplicitly identifying and authorizing implementation of the plan.\n(5) By October 1, 2026, and annually thereafter, the KCTCS shall submit a report to\nthe Legislative Research Commission for referra l to the Interim Joint Committees\non Education and Appropriations and Revenue providing the location, size of\nproperty, square footage of buildings, whether owned, leased, or rented, and the use\nof each property or building utilized by each college within the system, including\nall main campuses and satellite facilities, buildings, and properties as of January 1\nof the year of submission.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57980","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:16Z","sha256":"22d20d674481fb0366860f0c70e5b0d6f7cb248cf7de3aaa8b78ac9fd8afcdfe","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.590","next":"us-ky/krs-164.593"},"notice":"GroundRules: Original legal text.
