{"data":{"id":"us-ky/krs-164.6903","jurisdiction":"us-ky","citation":"KRS 164.6903","heading":"Definitions for KRS  164.6901 to 164.6935.","body":"As used in KRS 164.6901 to 164.6935, unless the context requires otherwise:\n(1) \"Agency contract\" means an agreement in which a student-athlete authorizes a\nperson  to  negotiate or  solicit on  behalf of  the  student-athlete a\nprofessional-sports-services contract; a name, image, and likeness agreement\nas defined in KRS 164.6941; or an endorsement contract;\n(2) \"Athlete agent\":\n(a) Means  an  individual, whether registered under KRS  164.6901  to\n164.6935 or not, who:\n1. Directly or indirectly, recruits or solicits a student-athlete to enter into\nan agency contract or, for compensation, procures employment or\noffers, promises, attempts, or negotiates to obtain employment for a\nstudent-athlete as  a  professional athlete or  member  of a\nprofessional sports team or organization;\n2. For compensation or in anticipation of compensation related to a\nstudent-athlete's participation in athletics:\na. Serves the student-athlete in an advisor capacity on a matter\nrelated to finances, business pursuits, or career management\ndecisions, unless the individual is an  employee  of an\neducational institution acting exclusively as an employee of the\ninstitution for the benefit of the institution; or\nb. Manages  the business affairs of the student-athlete by\nproviding assistance with bills, payments, contracts or taxes; or\n3. In anticipation of representing a student-athlete for a purpose\nrelated to the student-athlete's participation in athletics:\na. Gives consideration to the student-athlete or another person;\nb. Serves the student-athlete in an advisory capacity on a matter\nrelated to finances, business pursuits, or career management\ndecisions; or\nc. Manages  the business affairs of the student-athlete by\nproviding assistance with bills, payments, contracts, or taxes;\nand\n(b) Does not include an individual who:\n1. Acts solely on behalf of a professional sports team or organization;\nor\n2. Is a licensed, registered, or certified professional and offers or\nprovides services to a student-athlete customarily provided by\nmembers  of the profession, unless the individual:\na. Also recruits or solicits the student-athlete to enter into an\nagency contract;\nb. For compensation, procures employment or offers, promises,\nattempts, or  negotiates to obtain employment  for the\nstudent-athlete as a professional athlete or member  of a\nprofessional sports team or organization; or\nc. Receives consideration for providing the services calculated\nusing a different method than for an individual who is not a\nstudent-athlete; or\n3. Is a parent or guardian of a student-athlete, unless the parent or\nguardian for compensation, or any form of valuable consideration or\nreasonable expectation thereof, influences or attempts to influence\nthe student-athlete to enter into an agency contract, or procures\nemployment  or offers, promises, attempts, or negotiates to obtain\nemployment  for the student-athlete as a professional athlete or\nmember  of a professional sports team or organization;\n(3) \"Athletic director\" means an individual responsible for administering the overall\nathletic program of an educational institution or, if an educational institution has\nseparately administered athletic programs for male and female students, the\nathletic program for males or the athletic program for females, as appropriate;\n(4) \"Contact\" means a communication, direct or indirect, between an athlete agent\nand a student-athlete, to recruit or solicit the student-athlete to enter into an\nagency contract;\n(5) \"Department\" means  the Department of Professional Licensing in the Public\nProtection Cabinet;\n(6) \"Educational institution\" includes a  public or private elementary school,\nsecondary school, technical or vocational school, community college, college,\nand university;\n(7) \"Endorsement contract\" means an agreement under which a student-athlete is\nemployed  or receives consideration to use on behalf of the other party any\nvalue that the student-athlete may  have because of publicity, reputation,\nfollowing, or fame obtained because of athletic ability or performance;\n(8) \"Enrolled\" means  registered for courses and attending athletic practice or\nclass;\n(9) \"Intercollegiate sport\" means  a sport played at the collegiate level for which\neligibility requirements for participation by a student-athlete are established by\na national association that promotes or regulates collegiate athletics;\n(10) \"Interscholastic sport\" means  a sport played between educational institutions\nthat are not community colleges, colleges, or universities;\n(11) \"Licensed, registered, or certified professional\" means  an individual licensed,\nregistered, or certified as an attorney, dealer in securities, financial planner,\ninsurance agent, real estate broker or sales agent, tax consultant, accountant,\nor member  of a profession other than that of an athlete agent who is licensed,\nregistered, or certified by the state or a nationally recognized organization that\nlicenses, registers, or certifies members  of the profession on the basis of\nexperience, education, or testing;\n(12) \"Person\" means  an  individual, corporation, business trust, estate, trust,\npartnership, limited liability company, association, joint venture, or government;\ngovernmental subdivision, agency, or instrumentality; public corporation, or any\nother legal or commercial entity;\n(13) \"Professional-sports-services contract\" means  an agreement under which an\nindividual is employed, or agrees to render services, as a player on a\nprofessional sports team, with a professional sports organization, or as a\nprofessional athlete;\n(14) \"Record\" means  information that is inscribed on a tangible medium  or that is\nstored in an electronic or other medium and is retrievable in perceivable form;\n(15) \"Recruit or solicit\" means to attempt to influence the choice of an athlete agent\nby a student-athlete or, if the student-athlete is a minor, a parent or guardian of\nthe student-athlete. The term does not include giving advice on the selection of\na particular agent in a family, coaching, or social situation unless the individual\ngiving the advice does so because of the receipt or anticipated receipt of an\neconomic benefit, directly or indirectly, from the agent;\n(16) \"Registration\" means  registration as an  athlete agent pursuant to KRS\n164.6901 to 164.6935;\n(17) \"Sign\" means with present intent to authenticate or adopt a record:\n(a) To execute or adopt a tangible symbol; or\n(b) To attach to or logically associate with the record an electronic symbol,\nsound, or process;\n(18) \"State\" means  a state of the United States, the District of Columbia, Puerto\nRico, the United States Virgin Islands, or any territory or insular possession\nsubject to the jurisdiction of the United States; and\n(19) \"Student-athlete\" means an individual who is eligible to attend an educational\ninstitution and engages in, is eligible to engage in, or may be eligible in the\nfuture  to  engage  in, any  interscholastic or  intercollegiate sport.\n\"Student-athlete\" does not include an individual permanently ineligible to\nparticipate in a particular interscholastic or intercollegiate sport for that sport.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52051","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:16Z","sha256":"5c34903fd19378d8a3b0a9bf3ddc5093cc2999669319fbf2d536ae6faa11df4b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.6901","next":"us-ky/krs-164.6905"},"notice":"GroundRules: Original legal text.
