{"data":{"id":"us-ky/krs-164.6909","jurisdiction":"us-ky","citation":"KRS 164.6909","heading":"Contents of application -- Certificate from other state -- Cooperation with","body":"other organizations.\n(1) An applicant for registration as an athlete agent shall submit an application for\nregistration to the department in a form prescribed by the d epartment. An\napplication filed under this section is a public record. The applicant shall be an\nindividual, and the application shall be signed by the applicant under penalty of\nperjury. The application shall contain at least the following:\n(a) The name a nd date and place of birth of the applicant and the following\ncontact information for the applicant:\n1. The address of the applicant's principal place of business;\n2. Work and mobile telephone numbers; and\n3. Any means of communicating electronically, incl uding a facsimile\nnumber, electronic mail address, and personal and business or employer\nWeb sites;\n(b) The name of the applicant's business or employer, if applicable, including for\neach business or employer, the mailing address, telephone number,\norganization form, and the nature of the business;\n(c) Each social media account with which the applicant or the applicant's business\nor employer is affiliated;\n(d) Each business or occupation engaged in by the applicant for the five (5) years\nbefore the date of the application, including self-employment and employment\nby others, and any professional or occupational license, registration, or\ncertification held by the applicant during that time;\n(e) A description of the applicant's:\n1. Formal training as an athlete;\n2. Practical experience as an athlete agent; and\n3. Educational background relating to the applicant's activities as an athlete\nagent;\n(f) The name of each student -athlete for whom the applicant acted as an athlete\nagent within five (5) years before the date of the application or, if the student -\nathlete is a minor, the name of the parent or guardian of the minor, together\nwith the student-athlete's sport and last known team;\n(g) The name and address of each person that:\n1. Is a partner, mem ber, officer, manager, associate, or profit sharer or\ndirectly or indirectly holds an equity interest of five percent (5%) or\nmore of the athlete agent's business if it is not a corporation; and\n2. Is an officer or director of a corporation employing the athlete agent or a\nshareholder having an interest of five percent (5%) or more in the\ncorporation;\n(h) A description of the status of any application by the applicant or any person\nnamed pursuant to paragraph (g) of this subsection for a state or federal\nagency, including any denial, refusal to renew, suspension, withdrawal, or\ntermination of the license and any reprimand or censure related to the license;\n(i) Whether the applicant or any person named pursuant to paragraph (g) of this\nsubsection has been con victed of, or has charges pending for, a crime that\nwould involve sexual misconduct, has dishonesty as a necessary element, or\nwould be a felony if committed in this state, and, if so, identification of:\n1. The crime;\n2. The law enforcement agency involved; and\n3. If applicable, the date of the conviction and the fine or penalty imposed;\n(j) Whether, within fifteen (15) years before the date of the application, the\napplicant or any person named pursuant to paragraph (g) of this subsection has\nbeen a defenda nt or respondent in a civil proceeding, including a proceeding\nseeking an adjudication of legal incompetence, and if so, the date and a full\nexplanation of each proceeding;\n(k) Whether the applicant or any person named pursuant to paragraph (g) of this\nsubsection has an unsatisfied judgment of continuing effect, including\nalimony or a domestic order in the nature of child support, which is not\ncurrent at the date of the application;\n(l) Whether, within ten (10) years before the date of the application, the applicant\nor any person named pursuant to paragraph (g) of this subsection was\nadjudicated bankrupt or was an owner of a business that was adjudicated\nbankrupt;\n(m) Whether there has been any administrative or judicial determination that the\napplicant or any person named pursuant to paragraph (g) of this subsection has\nmade a false, misleading, deceptive, or fraudulent representation;\n(n) Each instance in which the conduct of the applicant or any person named\npursuant to paragraph (g) of this subsection res ulted in the imposition of a\nsanction, suspension, or declaration of ineligibility to participate in an\ninterscholastic or intercollegiate, or professional athletic event on a student -\nathlete or a sanction on an educational institution;\n(o) Each sanction, suspension, or disciplinary action taken against the applicant or\nany person named pursuant to paragraph (g) of this subsection arising out of\noccupational or professional conduct;\n(p) Whether there has been any denial of an application for, suspension or\nrevocation of, refusal to renew, or abandonment of the registration of the\napplicant or any person named pursuant to paragraph (g) of this subsection as\nan athlete agent in any state;\n(q) Each state in which the applicant currently is registered as an athl ete agent or\nhas applied to be registered as an athlete agent; and\n(r) If the applicant is certified or registered by a professional league or players\nassociation:\n1. The name of the league or association;\n2. The date of certification or registration, and the date of expiration of the\ncertification or registration, if any; and\n3. If applicable, the date of any denial of an application for, suspension or\nrevocation of, refusal to renew, withdrawal of, or termination of\nregistration; and\n(s) Any additional information required by the department.\n(2) Instead of proceeding under subsection (1) of this section, an individual registered\nas an athlete agent in another state, may apply for registration as an athlete agent in\nthis state by submitting to the department:\n(a) A copy of the application for registration in the other state;\n(b) A statement that identifies any material change in the information on the\napplication or verifies that there is no material change in the information,\nsigned under penalty of perjury; and\n(c) A copy of the certificate of registration from the other state.\n(3) The department shall issue a certificate of registration to an individual who applies\nfor registration under subsection (2) of this section if the department determines:\n(a) The application and registration requirements of the other state are\nsubstantially similar to or more restrictive than the Commonwealth's; and\n(b) The registration has not been revoked or suspended and no action involving\nthe individual's conduct as an athlete agent is pending against the individual or\nthe individual's registration in any state.\n(4) For purposes of implementing subsection (3) of this section, the department shall:\n(a) Cooperate with national organizations concerned with athlete agent issues  and\nagencies in other states which register athlete agents to develop a common\nregistration form and determine which states have laws that are substantially\nsimilar to or more restrictive than the Commonwealth's; and\n(b) Exchange information, including in formation related to actions taken against\nregistered agents or their registrations, with those organizations and agencies.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48378","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:16Z","sha256":"1ee4cec1d7380bd02c01944631aac6d6b8db468d0c075fb9d9bccf06ed9c57bd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.6907","next":"us-ky/krs-164.6911"},"notice":"GroundRules: Original legal text.
