{"data":{"id":"us-ky/krs-164.6917","jurisdiction":"us-ky","citation":"KRS 164.6917","heading":"Requirements for agency contract.","body":"(1) An agency contract must be in a record, signed or otherwise authenticated by the\nparties.\n(2) An agency contract shall contain:\n(a) A statement that the athlete agent is registered as an athlete agent in this state\nand a list of other states in which the agent is registered as an athlete agent;\n(b) The amount and method of calculating the consideration to be paid by the\nstudent-athlete for services to be provided by the athlete agent under the\ncontract and any other consideration the athlete agent has recei ved or may\nreceive from any other source for entering into the contract or for providing\nthe services;\n(c) The name of any person not listed in the athlete agent's application for\nregistration or renewal of registration who will be compensated because the\nstudent-athlete signed the contract;\n(d) A description of any expenses that the student-athlete agrees to reimburse;\n(e) A description of the services to be provided to the student-athlete;\n(f) The duration of the contract; and\n(g) The date of execution.\n(3) Subject to subsection (7) of this section, an agency contract shall contain a\nconspicuous notice in boldface type and in substantially the following form:\nWARNING TO STUDENT-ATHLETE\nIF YOU SIGN THIS CONTRACT:\n(1) YOU MAY LOSE YOUR ELIGIBILITY TO COMPETE AS A STUDENT -\nATHLETE IN YOUR SPORT;\n(2) IF YOU HAVE AN ATHLETIC DIRECTOR, WITHIN 72 HOURS AFTER\nSIGNING THE CONTRACT OR BEFORE THE NEXT SCHEDULED\nATHLETIC EVENT IN WHICH YOU PARTICIPATE, WHICHEVER\nOCCURS FIRST, BOTH  YOU AND YOUR ATHLETE AGENT MUST\nNOTIFY YOUR ATHLETIC DIRECTOR THAT YOU HAVE ENTERED\nINTO THIS CONTRACT AND PROVIDE THE NAME AND CONTACT\nINFORMATION OF THE ATHLETE AGENT; AND\n(3) YOU MAY CANCEL THIS CONTRACT WITHIN 14 DAYS AFTER\nSIGNING IT. CANCELLATION OF  THIS CONTRACT MAY NOT\nREINSTATE YOUR ELIGIBILITY AS A STUDENT -ATHLETE IN YOUR\nSPORT.\n(4) An agency contract shall be accompanied by a separate record signed by the\nstudent-athlete or, if the athlete is a minor, the parent or guardian of the student -\nathlete acknowledging that signing the contract may result in the loss of the student-\nathlete's eligibility to participate in the student-athlete's sport.\n(5) A student-athlete or, if the student -athlete is a minor, the parent or guardian of the\nstudent-athlete may void an agency contract that does not conform to this section. If\nthe contract is voided, any consideration received from the athlete agent under the\ncontract to induce entering into the contract is not required to be returned.\n(6) At the time an agenc y contract is executed, the athlete agent shall give the student -\nathlete or, if the student -athlete is a minor, the parent or guardian of the student -\nathlete a copy in a record of the contract and the separate acknowledgement\nrequired by subsection (4) of this section.\n(7) If a student is a minor, an agency contract shall be signed by the parent or guardian\nof the minor and the notice required by subsection (3) of this section shall be\nrevised accordingly.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48383","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:17Z","sha256":"2ee15321bb50b9081685288ce8cb5e6698207ad3a47340f10169411ecf68ab67","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.6915","next":"us-ky/krs-164.6919"},"notice":"GroundRules: Original legal text.
