{"data":{"id":"us-ky/krs-164.6919","jurisdiction":"us-ky","citation":"KRS 164.6919","heading":"Notice to athletic director -- Responsibilities of student -athlete, athlete","body":"agent, and educational institution.\n(1) In this section, \"communicating or attempting to communicate\" means contacting\nor attempting to contact by an in-person meeting, a record, or any other method that\nconveys or attempts to convey a message.\n(2) Within seventy-two (72) hours after entering into an agency contract or before the\nnext scheduled athletic event in which the student -athlete may participate,\nwhichever occur s first, the athlete agent shall give notice in a record of the\nexistence of the contract to the athletic director of the educational institution at\nwhich the student-athlete is enrolled or the athlete agent has reasonable grounds to\nbelieve the student-athlete intends to enroll.\n(3) Within seventy-two (72) hours after entering into an agency contract or before the\nnext scheduled athletic event in which the student -athlete may participate,\nwhichever occurs first, the student -athlete shall inform the athleti c director of the\neducational institution at which the student -athlete is enrolled that he or she has\nentered into an agency contract and the name and contact information of the athlete\nagent.\n(4) If an athlete agent enters into an agency contract with a s tudent-athlete and the\nstudent-athlete subsequently enrolls at an educational institution, the agent shall\nnotify the athletic director of the institution of the existence of the contract not later\nthan seventy-two (72) hours after the agent knew or should have known the student-\nathlete enrolled.\n(5) If an athlete agent has a relationship with a student-athlete before the student-athlete\nenrolls in an educational institution and receives an athletic scholarship from the\ninstitution, the athlete agent shall notify the institution of the relationship not later\nthan ten (10) days after the enrollment if the agent knows or should have known of\nthe enrollment and:\n(a) The relationship was motivated in whole or in part by the intention of the\nathlete agent to recr uit or solicit the athlete to enter an agency contract in the\nfuture; or\n(b) The athlete agent directly or indirectly recruited or solicited the student -\nathlete to enter an agency contract before the enrollment.\n(6) An athlete agent shall give notice in a record to the athletic director of any\neducational institution at which a student -athlete is enrolled before the agent\ncommunicates or attempts to communicate with:\n(a) The student-athlete or, if the student-athlete is a minor, a parent or guardian of\nthe student-athlete, to influence the student -athlete or parent or guardian to\nenter into an agency contract; or\n(b) Another individual to have that individual influence the student -athlete or, if\nthe student-athlete is a minor, the parent or guardian of the s tudent-athlete to\nenter into an agency contract.\n(7) If a communication or attempt to communicate with an athlete agent is initiated by\na student-athlete or another individual on behalf of the student -athlete, the athlete\nagent shall notify in a record the athletic director of any educational institution at\nwhich the stu dent-athlete is enrolled. The notification shall be made not later than\nten (10) days after the communication or attempt.\n(8) An educational institution that becomes aware of a violation of KRS 164.6901 to\n164.6935 by an athlete agent shall notify the depa rtment and any professional\nleague or players association with which the institution is aware the athlete agent is\nlicensed or registered of the violation.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48384","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:17Z","sha256":"2376df7a8efc9d32321f780c5aafe91d746a04ece8e888dc611dc0341b7160e0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.6917","next":"us-ky/krs-164.6921"},"notice":"GroundRules: Original legal text.
