{"data":{"id":"us-ky/krs-164.6925","jurisdiction":"us-ky","citation":"KRS 164.6925","heading":"Prohibited acts -- Authorization to pay certain expenses.","body":"(1) Except as otherwise provided in subsection (3) of this section, an athlete agent, with\nthe intent to influence a student -athlete or, if the student-athlete is a minor, a parent\nor guardian of the student-athlete to enter into an agency contract, may not ta ke any\nof the following actions or encourage any other individual to take or assist any other\nindividual in taking any of the following actions on behalf of the athlete agent:\n(a) Give any materially false or misleading information or make a materially false\npromise or representation;\n(b) Furnish anything of value to a student -athlete before the student-athlete enters\ninto the agency contract; or\n(c) Furnish anything of value to any individual other than the student -athlete or\nanother registered athlete agent.\n(2) An athlete agent shall not intentionally do any of the following or encourage any\nother individual to do any of the following on behalf of the agent:\n(a) Initiate contact, directly or indirectly, with a student -athlete or, if the student -\nathlete is  a minor, a parent or guardian of the student -athlete, to recruit or\nsolicit the student -athlete, parent, or guardian to enter an agency contract\nunless registered under KRS 164.6901 to 164.6935;\n(b) Fail to create or retain or permit inspection of the rec ords required to be\nretained by KRS 164.6923;\n(c) Fail to register when required by KRS 164.6907;\n(d) Provide materially false or misleading information in an application for\nregistration or renewal of registration;\n(e) Predate or postdate an agency contract; or\n(f) Fail to notify a student -athlete or, if the student -athlete is a minor, a parent or\nguardian of the student -athlete, before the student -athlete, parent, or guardian\nsigns or otherwise authenticates an agency contract for a particular sport that\nthe signing or authentication may make the student -athlete ineligible to\nparticipate as a student-athlete in that sport.\n(3) An athlete agent registered under KRS 164.6901 to 164.6935 who is certified as an\nathlete agent in a particular sport by a national  association that promotes or\nregulates intercollegiate athletics and establishes eligibility standards for\nparticipation by a student athlete in the sport may pay expenses incurred before the\nsigning of an agency contract by a student athlete, a family me mber of the student\nathlete, and an individual who is a member of a class of individuals authorized to\nreceive payment for the expenses by the national association that certified the agent\nif the expenses are:\n(a) For the benefit of the athlete who is a member of a class of athletes authorized\nto receive the benefit by the national association that certified the agent;\n(b) Of a type authorized to be paid by a certified agent by the national association\nthat certified the agent; and\n(c) For a purpose authorized by the national association that certified the agent.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48961","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:17Z","sha256":"6fe5b10e4340c8d29af967f205e2eb8c9301c656f09d80baf782a2124b1eefa0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.6923","next":"us-ky/krs-164.6927"},"notice":"GroundRules: Original legal text.
