{"data":{"id":"us-ky/krs-164.6941","jurisdiction":"us-ky","citation":"KRS 164.6941","heading":"Definitions for KRS 164.6941 to 164.6951.","body":"As used in KRS 164.6941 to 164.6951, unless context otherwise requires:\n(1) \"Affiliated corporation\" means an entity created or designated by the governing\nboard of an institution under KRS 164A.610 by adopted resolution;\n(2) \"Agency contract\" has the same meaning as in KRS 164.6903;\n(3) \"Athlete agent\" has the same meaning as in KRS 164.6903;\n(4) \"Compensation\" means anything of value, monetary or otherwise, including but not\nlimited to cash, gifts, in -kind items of value, social media compensation, paymen ts\nfor licensing or use of publicity rights, payments for other intellectual or intangible\nproperty rights under federal or state law, and any other form of payment or\nremuneration, but shall exclude:\n(a) Tuition, room, board, books, fees, and personal exp enses that a postsecondary\neducational institution provides a student -athlete in accordance with the rules\nof the intercollegiate athletic association of which the institution is a member;\n(b) Federal Pell Grants and other state and federal grants or schol arships\nunrelated to and not awarded because of a student -athlete's participation in\nintercollegiate athletics or sports competitions;\n(c) Any other financial aid, benefits, or awards that an institution provides a\nstudent-athlete in accordance with the ru les of the intercollegiate athletic\nassociation of which the institution is a member; or\n(d) The payment of wages and benefits to a student -athlete by an institution for\nwork actually performed, but not for athletic ability or participation in\nintercollegiate athletics, at a rate commensurate with the prevailing rate for\nsimilar work in the locality of the institution;\n(5) \"Enrolled\" has the same meaning as in KRS 164.6903;\n(6) \"Image\" means a picture or video of the student-athlete;\n(7) \"Institutional agreement\" means a written contract or agreement between a student -\nathlete and an institution or its affiliated corporations that gives compensation to the\nathlete, including but not limited to sharing revenue as permitted or as required by a\nlegal settlement or applicable law. Such compensation may be in exchange for the\nuse of the student athlete's name, image, or likeness, institutional brand promotion,\nor other rights;\n(8) \"Intercollegiate athletic association\" or \"association\" means any athletic association,\nathletic conference, or other similar organization which acts as an organizing,\nsanctioning, scheduling, or rule -making body of intercollegiate athletic events in\nwhich post secondary educational institutions take part, or an officer, director, or\nemployee of such entities;\n(9) \"Intercollegiate athletics\" has the same meaning as \"intercollegiate sport\" in KRS\n164.6903;\n(10) \"Likeness\" means a physical, digital, or other depict ion or representation of the\nstudent-athlete;\n(11) \"Name\" means the first, middle, or last name, or nickname of the student -athlete\nwhen used in a context that reasonably identifies the student -athlete with\nparticularity, which may include a team number, symbol, logo, or brand;\n(12) \"Name, image, and likeness agreement\" or \"NIL agreement\" means a written\ncontract or agreement between a student -athlete and a third party that gives\ncompensation to the athlete in exchange for the use of the athlete's name, ima ge, or\nlikeness;\n(13) \"Official team activities\" means activities a postsecondary educational institution\nrequires a student -athlete to participate in as part of an institutional agreement or\nother written team contract that includes but is not limited to games, practices,\nexhibitions, scrimmages, trainings, meetings, team appearances, team photograph\nand video sessions, individual photograph and video sessions, media interviews and\nappearances, marketing activities, team travel, and institutional camps and clinics;\n(14) \"Postsecondary educational institution\" or \"institution\" means a public or private\nKentucky college, university, or community college that participates in\nintercollegiate athletics, or an officer, director, or employee of such institutions;\n(15) \"Prevailing range of compensation\" means a range of compensation for a valid\nbusiness purpose related to the promotion or endorsement of goods or services\nprovided to the general public for profit, with compensation at rates and terms\ncommensurate wit h compensation paid to similarly situated student -athletes who\nare not current or prospective student-athletes at the institution;\n(16) \"Prospective student -athlete\" means a person who is not currently enrolled in a\npostsecondary educational institution bu t has been identified by that institution for\npossible recruitment and participation in intercollegiate athletics;\n(17) \"Recruit\" or \"recruitment\" means to attempt to influence a person's choice of\npostsecondary educational institution;\n(18) \"Student-athlete\" means a person who:\n(a) Has entered into an institutional agreement or other contract to enroll and\nparticipate in intercollegiate athletics as an athlete at an institution; or\n(b) Is enrolled and participates as an athlete in intercollegiate athletics  at an\ninstitution; and\n(19) \"Third party\" means a person or entity, other than an institution, affiliated\ncorporation, or an association, that offers, solicits, or enters into an NIL agreement.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55877","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:17Z","sha256":"2deb6f788d5c1b9216f06b2c77add69bc58eec9a97ced9ab40e963ed78bb7c1c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.6935","next":"us-ky/krs-164.6943"},"notice":"GroundRules: Original legal text.
