{"data":{"id":"us-ky/krs-164.6945","jurisdiction":"us-ky","citation":"KRS 164.6945","heading":"Compensation of student -athlete for use of name, image, or likeness --","body":"Compensation from institution -- Agreements -- Restrictions.\n(1) A student -athlete may receive compensation for the use of the athlete's name,\nimage, or likeness through a name, image, and likeness agreement with a third\nparty. Such compensation shall be consistent with the prevailing range of\ncompensation for the authorized use of the athlete's name, image, or likeness.\n(2) A student -athlete may receive compensation from an  institution or its affiliated\ncorporation, including but not limited to sharing revenue as permitted or required\nby a legal settlement or applicable law, by entering into a written institutional\nagreement with the institution or affiliated corporation. Su ch compensation may be\nin exchange for the use of the student -athlete's name, image, or likeness,\ninstitutional brand promotion, or other rights.\n(3) An institution or affiliated corporation may designate, through contract, sublicense,\nor other written agr eement, a media rights holder or one (1) or more other third\nparties with whom an institution's student -athletes may directly enter into NIL\nagreements consistent with the prevailing range of compensation.\n(4) A student -athlete shall not enter into an NIL agreement to receive compensation\nfrom a third party relating to the endorsement or promotion of:\n(a) Sports betting;\n(b) A controlled substance;\n(c) A substance the student -athlete's intercollegiate athletic association forbids\nthe athlete from using;\n(d) Adult entertainment; or\n(e) Products or services that would be illegal for the student -athlete to possess or\nreceive.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55879","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:17Z","sha256":"127cc48071b4a2cff5d8e2e1752cd5ed31865ba49ae91e925ef221ae7d6ed760","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.6943","next":"us-ky/krs-164.6947"},"notice":"GroundRules: Original legal text.
