{"data":{"id":"us-ky/krs-164.804","jurisdiction":"us-ky","citation":"KRS 164.804","heading":"Kentucky State University -- Duties of board of regents -- Review and","body":"closure of academic programs -- Limitations on areas of study -- Termination\nof employment.\n(1) The Kentucky State University board of regents, in consultation with the Council\non Postsecondary Education, shall conduct a thorough review of all academic\nprograms for long-term viability, financial stability, alignment with the university's\nmission as a polytechnic institution, the requirements of subsection (4) of this\nsection, and other criteria determined by the board and the council, and determine\nthe academic programs that the institution proposes to maintain. No later than June\n1, 2026, the board shall submit to the council for approval:\n(a) A list of the programs the board proposes to maintain; and\n(b) A list of the programs the board recommends to submit to the Southern\nAssociation of Colleges and Schools Commission on Colleges (SACSCOC)\nfor closure or other substantive change and the corresponding proposed teach -\nout plan or teach-out arrangement for each program recommended.\n(2) The Council on Postsecondary Education shall review the proposals and any teach -\nout plan and teach-out agreement submitted by the Kentucky State University board\nin accordance with subsection (1) of this section and may direct the board to amend\nany portion thereof prior to submitting a substantiative change for the review and\napproval of SACSCOC. Any substantiative change request necessary under this\nsection shall be submitted for the review and appro val of SACSCOC no later than\nJuly 1, 2026.\n(3) Kentucky State University shall close each program approved for closure by the\nSACSCOC and implement the corresponding teach-out plan or teach-out agreement\nas approved by that accrediting body.\n(4) Beginning with the 2026-2027 academic year and continuing for five (5) academic\nyears thereafter, Kentucky State University shall offer no more than ten (10)\nacademic areas of study, excluding any program that is:\n(a) Exclusively online;\n(b) In the college of education; and\n(c) Determined by the Council on Postsecondary Education to be necessary to the\nuniversity's mission as a polytechnic institution.\n(5) Notwithstanding any statute to the contrary, the president of Kentucky State\nUniversity shall have the authority  to terminate employment of any university\nemployee, including tenured employees in accordance with university policy, upon\nthirty (30) days' notice for the entire duration of the financial exigency declared in\nKRS 164.802. During this time, the university  shall retain only the faculty and staff\nnecessary to support the enrollment target of at least one thousand (1,000) in-person\nstudents and the programs maintained by the university in accordance with\nsubsections (1) and (4) of this section. Faculty and st aff employed in programs\nclosed in accordance with this section shall be terminated but shall not be\nprohibited from applying for other positions available at the university.\n(6) Notwithstanding subsections (4) and (5) of this section, Kentucky State University\nshall abide by all instructions provided by SACSCOC that are required to maintain\ninstitutional accreditation.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56864","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:18Z","sha256":"e7d8737dc17c99f7beda8963c9b3a6ef3f62289d2c05df1881953c70f9db59d1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.802","next":"us-ky/krs-164.806"},"notice":"GroundRules: Original legal text.
