{"data":{"id":"us-ky/krs-164.9481","jurisdiction":"us-ky","citation":"KRS 164.9481","heading":"Duty of postsecondary institution to maintain crime log -- Duty to report","body":"to campus community on crimes and threats to safety or security of students\nand employees.\n(1) Crime log:\n(a) Each postsecondary education institution shall make, keep, and mai ntain a\ndaily log, written in a form approved by the Council on Postsecondary\nEducation that can be easily understood, recording all crimes occurring on\ncampus and reported to campus security authorities or local law enforcement\nagencies, including:\n1. The category of crime, and a description of the incident, date, time, and\ngeneral location of each crime; and\n2. The disposition of the complaint if known, including referral for\nprosecution, institutional disciplinary proceedings, or investigation by\nanother state agency. The disposition shall include a reference to an\ninvestigation or incident report number.\n(b) All entries in the campus crime log shall be made available for public\ninspection within twenty -four (24) hours after the first report of an inciden t\nwas made to any campus security authority or local law enforcement officials.\n1. If there is clear and convincing evidence that the release of the\ninformation would cause a suspect to flee or evade detection, would\nresult in the destruction of evidence, or is prohibited from release by\nlaw, the information may be withheld until that damage is no longer\nlikely to occur from the release of the information. Only the information\nthat is absolutely necessary to withhold for the reasons stated in this\nparagraph may be withheld; all other information shall be released.\n2. In the event information is withheld under the provisions of paragraph\n(a) of this subsection, the crime shall still be reported and made\navailable for public inspection.\n(c) The campus crime lo g required by this section shall be readily accessible and\nopen for public inspection at all times and shall be made available on campus\ncomputer networks to which students, employees, and other campus\ncommunity members have access. Each semester the insti tution shall notify\ncurrently enrolled students, students applying to the institution, and employees\nof the availability of the campus crime log, where it can be accessed, and the\nexact electronic address on the computer network.\n(2) Special reports: In ad dition to the campus crime log, each postsecondary education\ninstitution shall make timely reports to the campus community on crimes reported\nto campus security authorities or local law enforcement authorities determined by\nthose authorities to present a safety or security threat to students or employees.\n(a) The reports shall be made available to students and employees within twenty -\nfour (24) hours after an incident is first reported.\n(b) The information shall be reported in a manner that will aid in the p revention\nof similar occurrences.\n(c) Institutions shall use computer networks and post the reports in each\nresidential facility. The institution may also use flyers and other campus\npublications including newspapers, and other media.\n(d) Each institution shall adopt a policy to comply with this requirement and the\npolicy shall be included in the postsecondary education institution's annual\ncampus safety and security report published in compliance with KRS\n164.9485.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=4504","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:18Z","sha256":"84ba9d52144342f3066773ca60a0e8ea59779d81f150bb05c4af45aee73b8558","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.948","next":"us-ky/krs-164.9483"},"notice":"GroundRules: Original legal text.
