{"data":{"id":"us-ky/krs-164.9492","jurisdiction":"us-ky","citation":"KRS 164.9492","heading":"Duty of public or private postsecondary institution to disclose existence or","body":"nonexistence of automatic fire suppression system in on -campus housing\nfacility -- Exemption.\n(1) Any public or private institution of postsecondary education which operates  or acts\nas agent for an on-campus housing facility within the Commonwealth shall disclose\nto any potential lessee as to whether the on -campus housing facility is or is not\nequipped with an automatic fire suppression system.\n(2) Except as provided in subsection (4) of this section, a two (2) part written disclosure\nstatement separate from other rental documents, with typeface of no less than\nfourteen (14) points, shall be signed by both parties acknowledging that disclosure\nof the presence or lack of an automatic fire suppression system has been made.\n(3) The potential lessee shall be given a copy of the disclosure form and a copy shall be\nretained by the lessor for the duration of the rental agreement. At the end of each\ncalendar year, institutions of posts econdary education shall make available, upon\nrequest from the state fire marshal or any local fire official, a copy of the disclosure\nform and an affidavit certifying that disclosure as to whether or not the premises\nwere equipped with an automatic fire s uppression system were provided as part of\nany rental agreement.\n(4) If the institution has an automatic fire suppression system in place and properly\nfunctioning at every on-campus housing facility under the control of the institution,\nthe institution shall be exempt from this section.","path":["KRS Chapter 164"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=4510","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:18Z","sha256":"7ff4cd320c9e38469d9a38e4a724f4d908da99d1f289331f1ba875cb7371ea40","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164.9490","next":"us-ky/krs-164.9495"},"notice":"GroundRules: Original legal text.
