{"data":{"id":"us-ky/krs-164a.590","jurisdiction":"us-ky","citation":"KRS 164A.590","heading":"Contracting for architectural and engineering services.","body":"(1) In the procurement of architectural and engineering services, the governing board of\nthe institution shall encourage firms engaged in the lawful practice of their\nprofession to submit an annual statement of qualifications and performance data.\n(2) When the need for architectural and engineering services arise for specific projects,\nthe governing board shall evaluate current statements of qualifications and\nperformance data on file with the Commonwealth, together with those that may be\nsubmitted by other fir ms and shall conduct discussions with no less than three (3)\nfirms regarding anticipated design concepts and the relative utility of alternative\nmethods of approach for furnishing the required services, and after applying the\nreciprocal preference for resi dent bidders under KRS 45A.494, shall then select\ntherefrom, in order of preference, based upon criteria established and published, no\nless than three (3) of the firms deemed to be the most highly qualified to provide the\nservices required.\n(3) The governing board shall negotiate a contract with the highest qualified firm for\narchitectural and engineering services at compensation which the governing board\ndetermines in writing to be fair and reasonable to the Commonwealth. In making\nthis decision, the governing board shall take into account the estimated value of the\nservices to be rendered, the scope, complexity, and professional nature thereof.\nShould the governing board be unable to negotiate a satisfactory contract with the\nfirm considered to be the most  qualified, at a price it determines to be fair and\nreasonable to the institution, negotiations with that firm shall be formally\nterminated. The governing board shall then undertake negotiations with the second\nmost qualified firm. Failing accord with the second most qualified firm, the\ngoverning board shall formally terminate negotiations with that firm. The governing\nboard shall then undertake negotiations with the third most qualified firm. Should\nthe governing board be unable to negotiate a satisfactory  contract with any of the\nselected firms, it shall select additional firms in order of their competence and\nqualification and the governing board shall continue negotiations in accordance\nwith this section until an agreement is reached.","path":["KRS Chapter 164A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=4582","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:19Z","sha256":"fd1931bc963dc27e42eff0184152b815f5467a1ba6c702791d1ecef44b98a370","source_id":"us-ky","stale":false,"prev":"us-ky/krs-164a.585","next":"us-ky/krs-164a.595"},"notice":"GroundRules: Original legal text.
