{"data":{"id":"us-ky/krs-17.142","jurisdiction":"us-ky","citation":"KRS 17.142","heading":"Segregation of criminal records.","body":"(1) Each law enforcement or other public agency in possession of arrest records,\nfingerprints, photographs, or other data whether in documentary or electronic form\nshall upon written request of the arrestee as provided herein segregate all records\nrelating to the arrestee in its files in a file separate and apart from those of convicted\npersons, if the person who is the subject of the records:\n(a) Is found innocent of the offense for which the records were made; or\n(b) Has had all charges relating to the offense dismissed; or\n(c) Has had all charges relating to the offense withdrawn.\n(2) A person who has been arrested and then has come within the purview of subsection\n(1) of this section may apply to the court in which the case was tried, or in which it\nwould ha ve been tried in the event of a dismissal or withdrawal of charges, for\nsegregation of the records in the case.  Upon receipt of such application the court\nshall forthwith issue an order to all law enforcement agencies in possession of such\nrecords to segregate the records in accordance with the provisions of this section.\n(3) Each law enforcement agency receiving an order to segregate records shall\nforthwith:\n(a) Segregate the records in its possession in a file separate and apart from records\nof convicted persons;\n(b) Notify all agencies with which it has shared the records or to which it has\nprovided copies of the records to segregate records; and\n(c) All records segregated pursuant to this section shall show disposition of the\ncase.\n(4) Records subject t o the provisions of KRS 431.076 or 431.078 shall be sealed as\nprovided in those statutes.","path":["KRS Chapter 17"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1205","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:37Z","sha256":"1e85c1a9dac4afa52ea10d7fcae6f822be308737165b0ef222e3c23fcb6686fd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-17.140","next":"us-ky/krs-17.143"},"notice":"GroundRules: Original legal text.
