{"data":{"id":"us-ky/krs-17.160","jurisdiction":"us-ky","citation":"KRS 17.160","heading":"Furnishing potential employer with person's record of convictions, guilty","body":"pleas, and Alford pleas involving specified crimes.\n(1) Notwithstanding any other provision of law, an employer may request from the\nJustice and Public Safety Cabinet or the Admi nistrative Office of the Courts, or\nboth, records of all available convictions involving any felony offense, any\nmisdemeanor offense in KRS Chapter 531 or KRS Chapter 510, any misdemeanor\noffense under KRS Chapter 218A committed within the five (5) years i mmediately\npreceding the application, or any conviction for violating KRS Chapter 189A\ncommitted within the five (5) years immediately preceding the application of a\nperson who applies for employment or volunteers for a position in which he or she\nwould ha ve supervisory or disciplinary power over a minor. The cabinet or the\nAdministrative Office of the Courts, as appropriate, shall furnish the information to\nthe requesting employer and shall also send a copy of the information to the\napplicant.\n(2) Any requ est for records under subsection (1) of this section shall be on a form\napproved by the cabinet and the Administrative Office of the Courts. No fee shall be\ncharged to the employer or to the person whose records were requested if funding\nfor the record che cks provided for in this section is provided through some other\nmechanism; otherwise the cabinet or the Administrative Office of the Courts may\ncharge a fee to be paid by the organization making the request, not to exceed the\nactual cost of processing the request.\n(3) The cabinet and the Administrative Office of the Courts shall promulgate\nadministrative regulations to implement the provisions of this section. No\nadministrative regulation shall be adopted requiring or authorizing the\nfingerprinting of applicants.\n(4) As used in this section, \"employer\" means any organization chartered by the\nCongress of the United States or specified by the Attorney General which employs\nor uses the services of volunteers or paid employees in positions in which the\nvolunteer or employee has supervisory or disciplinary power over a child or\nchildren. An organization which has an administrative office with paid personnel\nwhich has jurisdiction over suborganizations in one (1) or more counties shall make\napplication for record c hecks through the administrative office of the organization\nand not through each individual suborganization.\n(5) Offenses which may be searched for under this section are ones involving any\nconviction, plea of guilty, or Alford plea, to any offense specifi ed in subsection (1)\nof this section or the attempted violation of any offense specified in subsection (1)\nof this section. Conviction for a violation or attempted violation of an offense\ncommitted outside the Commonwealth of Kentucky is a crime if such offense would\nhave been a crime in Kentucky under subsection (1) of this section if committed in\nKentucky.","path":["KRS Chapter 17"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1218","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:38Z","sha256":"bf2740a79b500b122bbede63869b2912e5d604217daddd6a1226776df8c0225f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-17.157","next":"us-ky/krs-17.162"},"notice":"GroundRules: Original legal text.
