Means information collected by criminal justice agencies on individuals\nconsisting of identifiable descriptions and notations of arrests,\nindictments, information, or other formal criminal charges, and any\ndisposition arising therefrom, including sentencing, correction\nsupervision, and release;\n2. Includes information that is sealed pursuant to court order or other law if\nthe records are accessible by criminal justice agencies for the purpose of\nconducting background checks; and\n3. Does not include identification information such as fingerprint records\nto the extent that the inf ormation does not indicate involvement of the\nindividual in the criminal justice system;\n(b) \"Criminal justice agency\" means:\n1. The Kentucky Court of Justice;\n2. The Department of Kentucky State Police;\n3. Sheriffs;\n4. State and local correctional facilities;\n5. City, county, urban -county government, charter county government,\nconsolidated local government, and unified local government police\ndepartments;\n6. School resource officer departments;\n7. Airport safety and security departments;\n8. Any agency or department that employs a state officer, listed in KRS\n15.420(2)(a)2.; and\n9. Any other state or local agency in the Commonwealth of Kentucky that\nperforms the administration of criminal justice pursuant to a statute,\nexecutive order, or other law, and which allocates a majority of its\nannual budget to the administration of criminal justice; and\n(c) \"Requesting agency\" means:\n1. The United States Department of Defense;\n2. The United States Department of State;\n3. The United States Department of Transportation;\n4. The United States Office of Personnel Management;\n5. The Central Intelligence Agency;\n6. The Federal Bureau of Investigation;\n7. The United States Department of Homeland Security;\n8. The Office of the Director of National Intelligence;\n9. An executive agency of the United States that is:\na. Authorized to conduct background investigations under a federal\nstatute; or\nb. Delegated authority to conduct background investigations in\naccordance with procedures established by a security executive\nagent or a suitability executive agent under subsection (b) or\n(c)(iv) of Section 2.3 of Executive Order 13467, 73 Fed. Reg.\n38103, or any successor thereto; or\n10. A contractor that conducts a background investigation on behalf of an\nentity listed in subparagraphs 1. to 9. of this paragraph.\n(2) A criminal justice agency shall provide criminal history records information to a\nrequesting agency when that requesting agency is conducting a basic suitability or\nfitness assessment for federal or contractor employees under 5 U.S.C. sec. 9101 and\nrequests that information from the criminal justice agency.\n(3) A criminal justice agency may request a fee of twenty -five dollars ($25) to be paid\nby the requesting agency for reimbursement of ex penses related to providing\ncriminal history records information.
