{"data":{"id":"us-ky/krs-17.165","jurisdiction":"us-ky","citation":"KRS 17.165","heading":"Definitions -- Criminal record check for job applicants at child-care","body":"centers  -- Restrictions on  employing  violent offenders or persons\nconvicted of sex crimes -- Conviction information for applicant seeking\nemployment  as child-serving professional.\n(1) As used in this section, \"sex crime\" means a conviction or a plea of guilty to a\nsex crime specified in KRS 17.500.\n(2) As  used in this section, \"violent offender\" means  any person who has been\nconvicted of or pled guilty to the commission of a capital offense, Class A\nfelony, or Class B felony involving the death of the victim, or rape in the first\ndegree or sodomy in the first degree of the victim or serious physical injury to a\nvictim.\n(3) As used in this section, \"violent crime\" shall mean a conviction of or a plea of\nguilty to the commission of a capital offense, Class A felony, or Class B felony\ninvolving the death of the victim, or rape in the first degree or sodomy in the\nfirst degree of the victim or serious physical injury to a victim.\n(4) As  used in this section, \"criminal offense against a victim who is a minor\"\nmeans  a conviction of or a plea of guilty to a criminal offense against a victim\nwho  is a minor as specified in KRS 17.500(3).\n(5) (a) Excluding a child care staff member  pursuant to KRS  199.8965, the\nprovisions of this section shall apply to all applicants for initial\nemployment  in a position which involves care and supervision of a minor\nas a child-serving professional on or after March 27, 2017.\n(b) Each  employer of an applicant for initial employment in a position which\ninvolves care and supervision of a minor as a child-serving professional\nshall request all conviction information for the applicant for employment\nfrom the Justice and Public Safety Cabinet or the Administrative Office of\nthe Courts prior to employing the applicant.\n(c) This subsection shall not be construed to apply to an employer of a\nminor.\n(6) No  employee in a position which involves care and supervision of a minor as a\nchild-serving professional pursuant to subsection (5) of this section shall have\nbeen convicted of a violent crime, a criminal offense against a victim who is a\nminor, or a sex crime, or have been found by the Cabinet for Health and Family\nServices or a court to have abused or neglected a child.\n(7) Each  application form, provided by the employer to the applicant, shall\nconspicuously state the following: \"FOR  THIS  TYPE  OF  EMPLOYMENT,\nSTATE  LAW  REQUIRES  A CRIMINAL  RECORD  CHECK  AS A CONDITION\nOF  EMPLOYMENT.\"\n(8) Any request for records under subsection (5) of this section shall be on a form\napproved by the Justice and Public Safety Cabinet or the Administrative Office\nof the Courts, and the cabinet may charge a fee to be paid by the applicant in\nan amount no greater than the actual cost of processing the request.","path":["KRS Chapter 17"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45604","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:38Z","sha256":"7d08b9400c6c04d8bcb226027e3b41ba382fafba6865b10d3dca018f3b22f8eb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-17.162","next":"us-ky/krs-17.167"},"notice":"GroundRules: Original legal text.
