{"data":{"id":"us-ky/krs-17.185","jurisdiction":"us-ky","citation":"KRS 17.185","heading":"Request to Department of Kentucky State Police to conduct background","body":"check on oneself through name -based or fingerprint -supported search --\nDefinitions for section -- Prerequisites and limitations on search and release of\ninformation -- Fees -- Administration regulations.\n(1) As used in this section:\n(a) \"Fingerprint card\" means the standard Federal Bureau of Investigation FD-258\nfingerprint card;\n(b) \"Fingerprint-supported background check\" means a statewide search of the\ncentralized criminal history record information system created and maintained\nby the Commonwealth utilizing the fingerprints of the subject of the\nbackground check. This shall not include a national check by the Federal\nBureau of Investigation unless other provisions require a national check; and\n(c) \"Name-based background check\" means a statewide search of the centralized\ncriminal history record information system created and maintained by the\nCommonwealth utilizing the name, date of birth, and Social Security number\nof the subject of the background check. This shall not include a national check\nby the Federal Bureau of Investigation.\n(2) Any other provision of law to the contrary notwithstanding, a person may request\nthe Department of Kentucky State Police to conduct a name -based or fingerprint -\nsupported background check of himself or herself and release the results to any\nperson designated by the requester.\n(3) A person requesting a fingerprint-supported background check on himself or herself\nshall be fingerprinted by a law enforcement agency or other agency approved by the\nDepartment of Kentucky State Police to submit fingerprints. The fingerprinting\nagency shall forward the fingerprints to the Department of Kentucky State Police.\nThe fingerprinting agency may charge a fee, not to exceed the actual cost of\nprocessing the request.\n(4) A request for a name -based or fingerprint -supported background check shall be\nsubmitted in a manner approved by the Department of Kentucky State Police.\n(5) The Department of Kentucky State Police ma y charge a fee for conducting a\nbackground check, not to exceed the actual cost of processing the request, to be paid\nby the requester, except that a convenience fee of ten dollars ($10) may be assessed\nfor electronic requests and shall be retained by the Department of Kentucky State\nPolice.\n(6) The Department of Kentucky State Police shall promulgate administrative\nregulations to implement the provisions of this section.","path":["KRS Chapter 17"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48088","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:38Z","sha256":"94a79cd9a350b242b306fc007d03e5f0500974fa135169fa5929683c277d2c50","source_id":"us-ky","stale":false,"prev":"us-ky/krs-17.180","next":"us-ky/krs-17.190"},"notice":"GroundRules: Original legal text.
