{"data":{"id":"us-ky/krs-17.190","jurisdiction":"us-ky","citation":"KRS 17.190","heading":"Emergency requests for call location information.","body":"(1) For purposes of this section:\n(a) \"Call location information\" means the best available location information,\nincluding but not limited to information obtained using historical cellular site\ninformation or a mobile locator tool;\n(b) \"Emergency responder\" has the same meaning as in KRS 194A.400;\n(c) \"Law enforcement agency\" means any lawfully organized investigative\nagency, sheriff's office, police unit, or police force of state, county, urban -\ncounty government, charter county, city, consolidated local govern ment, or a\ncombination of these, responsible for the detection of crime and the\nenforcement of the general criminal laws, and excludes constables.\n(d) \"Public safety answering point\" has the same meaning as in KRS 65.750;\n(e) \"Wireless communications devic e\" means any wireless electronic\ncommunication device that provides for voice or data communication between\ntwo (2) or more parties, including a mobile or cellular telephone; and\n(f) \"Wireless telecommunications carrier\" means a provider of commercial\nmobile radio services, including all broadband personal communications\nservices, wireless radio telephone services, geographic area specialized and\nenhanced specialized mobile radio services, and incumbent wide area\nspecialized mobile radio licenses, which off er real -time, two -way voice\nservices interconnected with the public switched telephone network and doing\nbusiness in this Commonwealth.\n(2) (a) Upon a request from a public safety answering point or law enforcement\nagency, a wireless telecommunications car rier shall provide call location\ninformation concerning the wireless communications device of a wireless\ntelecommunications user to the requesting public safety answering point or\nlaw enforcement agency, in order to respond to a call for emergency services\nor in an emergency situation that involves the imminent risk of death or\nserious physical injury.\n(b) Local emergency responders seeking call location information under this\nsection shall direct inquiries to either a public safety answering point or a law\nenforcement agency, and the highest ranking person on duty at the public\nsafety answering point or a law enforcement agency shall determine, in\nconsultation with the emergency responders in the jurisdiction in which the\nemergency call or situation arose, whether the conditions under paragraph (a)\nof this subsection are met.\n(3)  Notwithstanding any other provision of law to the contrary, nothing in this section\nprohibits a wireless telecommunications carrier from establishing protocols by\nwhich the carrier could voluntarily disclose call location information.\n(4) No cause of action shall lie in any court against any wireless telecommunications\ncarrier or its officers, employees, or agents for providing call location information\nwhile acting in good faith and in accordance with this section.\n(5) (a) In order to facilitate requests for call location information in accordance with\nthis section, all wireless telecommunications carriers and all resellers of\nwireless telecommunications doing business in the Common wealth shall\nsubmit emergency contact information to:\n1. The Department of Kentucky State Police, for dissemination to law\nenforcement agencies; and\n2. The Kentucky 911 Services Board, as created in KRS 65.7623, for\ndissemination to public safety answering points.\n(b) The contact information required under this subsection shall be submitted\nannually, or immediately upon any change in contact information.\n(6) All public safety answering points and law enforcement agencies shall develop and\nmaintain policies and procedures regarding this section.\n(7) Call location information gathered pursuant to this section shall not be disclosed to\nany party who is not officially involved in the underlying emergency response.","path":["KRS Chapter 17"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49153","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:38Z","sha256":"fbb82bfb661d042d2216911e41885c631ac06cda91e964b8ccbb385aaa838664","source_id":"us-ky","stale":false,"prev":"us-ky/krs-17.185","next":"us-ky/krs-17.210"},"notice":"GroundRules: Original legal text.
