{"data":{"id":"us-ky/krs-17.544","jurisdiction":"us-ky","citation":"KRS 17.544","heading":"Restrictions on use of social media platform by registrants -- Retroactivity -","body":"- Penalties.\n(1) As used in this section, \"social media platform\":\n(a) Means a website or application that is open to the public, allows a user to\ncreate an account, and enables users to do all of the following:\n1. Interact socially with other users within the confines of the website or\napplication;\n2. Construct a public or semipublic profile for the purpose of signing into\nand using the website or application;\n3. Populate a list of other users with whom an individual shares or has the\nability to share a social connection within the website or application;\nand\n4. Create or post content viewable by others, including on message boards,\nchat rooms, video channels, direct or private messages, or chats, or on a\nlanding page or main feed that presents the user with content generated\nby other users; and\n(b) Does not include:\n1. A broadband internet access service as defined by the Federal\nCommunications Commission;\n2. An electronic mail service;\n3. A search engine service;\n4. A cloud storage or cloud computing service;\n5. An online service, application, or website in which interaction between\nusers is limited to reviewing products offered for sale by electronic\ncommerce or commenting on reviews posted by other users; or\n6. An online service, application, or website:\na. That consists primarily of information or content that is not user -\ngenerated but is preselected by the provider; and\nb. For which any chat, comments, or interactive functionality is\nincidental to, directly related to, or dependent upon the provision\nof the content described by subdivision a. of this subparagraph.\n(2) A registrant who has committed a criminal offense against a victim who is a minor\nshall not create or have control of an account on a social media platform unless the\naccount displays his or her full legal name.\n(3) This section shall apply retroactively.\n(4) Any person who violates subsection (2) of this section shall be guilty of a Class A\nmisdemeanor for the first offense, and a Class D felony for a second or subsequent\noffense.","path":["KRS Chapter 17"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55563","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:38Z","sha256":"628a455785d856b92fcb40fe2d0e81215b507d9f9a59148b53a63126138f7364","source_id":"us-ky","stale":false,"prev":"us-ky/krs-17.540","next":"us-ky/krs-17.545"},"notice":"GroundRules: Original legal text.
