{"data":{"id":"us-ky/krs-17.546","jurisdiction":"us-ky","citation":"KRS 17.546","heading":"Registrant prohibited from using electronic communications to","body":"communicate with or gather information about minors -- Exception for\nparents -- Registrant prohibited from photographing, filming, or making a\nvideo of a minor without consent of minor's parent or guardian.\n(1) (a) As used in this subsection, \"electronic communications\" means any transfer of\ninformation, including signs, signals, data, writings, images, sounds, text,\nvoice, and video, transmitted primarily through the use of electrons or\nelectromagnetic waves or particles.\n(b) Except as provided in paragraph (c) of this subsection, a registrant who has\ncommitted a criminal offense against a victim who is a minor after July 14,\n2018, shall not knowingly or intentionally use electronic co mmunications for\ncommunicating with or gathering information about a person who is less than\neighteen (18) years of age.\n(c) It is not a violation of paragraph (b) of this subsection for a registrant to use\nelectronic communications to communicate with or gather information about\na person under the age of eighteen (18) years of age if:\n1. The registrant is the parent of the person; and\n2. The registrant is not prohibited by court order, or the terms of probation,\nshock probation, conditional discharge, paro le, or any other form of\nearly release, from communicating with or gathering information about\na person.\n(2) No registrant shall intentionally photograph, film, or video a minor through\ntraditional or electronic means without the written consent of the min or's parent,\nlegal custodian, or guardian unless the registrant is the minor's parent, legal\ncustodian, or guardian.
