The board shall\napprove providers who shall conduct comprehensive sex offender presentence\nevaluations and treatment.\n(2) The board shall develop a comprehensive sex offender presentence evaluation that\nshall be used by approved providers in assessing the risk of recommitting a sex\ncrime by a sex offender, the threat posed to public safety, amenability to sex\noffender treatment, and the nature of the required sex offender treatment. The\nevaluation shall be based upon, but not limited to the following factors:\n(a) Criminal history;\n(b) Nature of the offense;\n(c) Conditions of release that minimize risk;\n(d) Physical conditions that minimize risk;\n(e) Psychological or psychiatric profiles;\n(f) Recent behavior that indicates an increased risk of recommitting a sex crime;\n(g) Recent threats or gestures against persons or expressions of an intent to\ncommit additional offenses; and\n(h) Review of the victim impact statement.","path":["KRS Chapter 17"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1262","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:38Z","sha256":"67d1ec763d4cb36a07d63c11f7bd30917d27879e16a908df175cbc62f0a51cb0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-17.552","next":"us-ky/krs-17.556"},"notice":"GroundRules: Original legal text.
