{"data":{"id":"us-ky/krs-171.215","jurisdiction":"us-ky","citation":"KRS 171.215","heading":"Department to purchase textbooks for use by nonpublic school pupils in","body":"grades one through twelve.\n(1) The Department for Libraries and Archives shall purchase textbooks from\npublishers whose books have been adopted by the State Quality Curr iculum Task\nForce under KRS 156.395 to 156.476 for distribution without cost to pupils\nattending grade one (1) through grade twelve (12) of the state's nonpublic schools\nwhich have been accredited by the State Department of Education.\n(2) The chief school administrator of each eligible school may file a requisition with\nthe state librarian for the books needed for the next ensuing school term. Textbooks\neligible for distribution by grade level or subject shall conform to the schedule in\nuse by the Kentucky Board of Education for distribution to the public schools.\n(3) The state librarian shall develop rules and regulations governing the purchase,\nrequisition, distribution, assignment to students, care, use and return of textbooks,\nand a plan for permanently labeling the textbooks as the property of the Department\nfor Libraries and Archives. The rules and regulations shall provide for the\nallocation of textbooks in a manner reflecting, and not to exceed the expressly\nlimited appropriation to fund the allocatio n. The rules and regulations shall be\ndeveloped in consultation with the Department of Education and shall conform,\nwithin statutory limits, to the rules and regulations already established by the\nKentucky Board of Education.\n(4) All textbooks purchased un der the provisions of this section are the property of the\nstate. Each school administrator obtaining books through the Department for\nLibraries and Archives is custodian of the books in his school. He shall issue the\nbooks to the students according to the  rules and regulations formulated by the state\nlibrarian.\n(5) Funds appropriated by the General Assembly to the Department for Libraries and\nArchives for this purpose shall not be expended for any textbooks which present a\nparticular religious philosophy a nd shall not be considered as or commingled with\ncommon school funds and shall be allocated each year to the nonpublic school\nstudents as provided by rule and regulation of the Department for Libraries and\nArchives to the extent allowed by the appropriatio n provided in 1978 Ky.
