{"data":{"id":"us-ky/krs-171.381","jurisdiction":"us-ky","citation":"KRS 171.381","heading":"Duties and functions of council -- Duties of state historic preservation","body":"officer.\n(1) The Kentucky Heritage Council shall be dedicated to the preservation and\nprotection of all meaningful vestiges of Kentucky's heritage for succeeding\ngenerations, and in pursuit of this dedication it shall engage in and concern itself\nwith worthy projects and other matters related to the conservation and continuing\nrecognition of buildings, structures, sites, and other landmarks associated with the\narchaeological, cultural, economic, military, natural, political, or social aspects of\nKentucky's history.\n(2) The duties and functions of the council shall be to:\n(a) Review and recommend appropriate projects and programs to insure the\nproper recognition, preservation, and p rotection of matters related to\nKentucky's heritage, particularly those in the nature of or associated with real\nproperty;\n(b) Advise, consult, and cooperate generally with state, local, and national\nofficials and agencies to accomplish the purposes to whi ch the council is\ndedicated, and specifically with the Kentucky Department of Parks and\nHistorical Society in matters of common concern;\n(c) Encourage, promote, and coordinate historic preservation programs being\nconducted in Kentucky by other agencies or groups, public and private;\n(d) Prepare and maintain an inventory or survey of Kentucky's resource of historic\nbuildings, sites, structures, and other landmarks, and list in an official roll\nthose landmarks which possess statewide or national significance; and\n(e) Conduct a survey and maintain a catalog of Kentucky's historic drylaid and\nhistoric mortared rock fences as defined in KRS 171.391.\n(3) The council may:\n(a) Accept grants or other funds or property from any available source, public or\nprivate;\n(b) Employ, with the approval of the Governor, staff as may be necessary. Any\nmember of the staff shall be entitled to compensation under KRS Chapter\n18A, and may be reimbursed for necessary and actual expenses in accordance\nwith the provisions of KRS Chapters 44 and 45;\n(c) Enter into contractual relationships as may be necessary;\n(d) Acquire real property, by gift or devise or by purchase pursuant to the\nprovisions of KRS 45A.045, and hold the same in the name of the\nCommonwealth for the use and benefit of the council;\n(e) Initiate its own projects of an appropriate nature, and undertake or otherwise\nengage in joint projects with other agencies or groups, public or private; and\n(f) Adopt rules and regulations as may be necessary and incidental to the\nperformance of the council's duties and functions.\n(4) The receipt, control, and expenditure of funds shall be subject to the general\nprovisions of the Kentucky Revised Statutes governing financial administration of\nall state agencies.\n(5) No provision of this section shall be construed as repealing any of the laws of the\nCommonwealth relating to the preservation, protection, and recognition of historical\nmatters, but shall be held and construed as ancillary and supplemental thereto.\n(6) The council shall receive applications, interview and recommend to the Governor\nthree (3) persons as nominees for appointment as the director of the Heritage\nDivision, Tourism, Arts and Heritage Cabinet. The director of the Heritage Division\nshall be the state historic preservation officer.\n(7) The responsibilities of the state historic preservation officer shall include:\n(a) Development for the State Historic Preservation Program;\n(b) Direction of a comprehensive statewide survey of historic properties;\n(c) Nomination of historic properties to the National Register of Historic Places;\n(d) Cooperation in the development of effective working relationships with\nfederal, state, and local agencies that participate in the management of historic\nproperties and in project planning that may affect historic properties;\n(e) Cooperation in the integration of historic preservation planning with all levels\nof planning;\n(f) Cooperation in the development and maintenance of a review procedure for\npublicly funded, assisted, and  licensed undertakings that may affect historic\nproperties within the state;\n(g) Participation in the review of federal, federally assisted, and federally licensed\nundertakings that may affect historic properties included in or eligible for\ninclusion in th e National Register under Section 106 of the National Historic\nPreservation Act and Executive Order 11593;\n(h) Assisting federal agencies in fulfilling their historic preservation\nresponsibilities under federal law and regulations;\n(i) Liaison with organiz ations of professional archaeologists, historians,\narchitects, architectural historians, planners, and others concerned with\nhistoric preservation;\n(j) Development and operation of a program of public information and education\nconcerning the preservation program;\n(k) Administration of the grants program within the state;\n(l) Preparation and maintenance of a comprehensive statewide historic\npreservation plan; and\n(m) The immediate transmittal to the Department of Parks and to the\nCommonwealth's Railtrail Dev elopment Office in the Department for Local\nGovernment of any information received from a railroad or other person\nhaving an ownership interest in a railroad corridor pertaining to a proposed or\npending action or proceeding to obtain federal authority for the regulatory\nabandonment of that railroad corridor.","path":["KRS Chapter 171"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=4804","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:22Z","sha256":"872018b2d687f243bf3d240193b27c8eef9028809f4c2b2f442e0cab5f006aad","source_id":"us-ky","stale":false,"prev":"us-ky/krs-171.3801","next":"us-ky/krs-171.382"},"notice":"GroundRules: Original legal text.
