{"data":{"id":"us-ky/krs-173.105","jurisdiction":"us-ky","citation":"KRS 173.105","heading":"Contract with county -- Support by county -- Effect of compact -- Effect on","body":"joint department upon establishment of consolidated local government.\n(1) The fiscal court of any county containing a population of over two hundred\nthousand (200,000) and a c ity of the first class, may contract with the board of\ntrustees of the free public library of any such city for the purpose of granting to the\nresidents and schools of such county the same privileges afforded by such library to\nresidents and schools in the city.\n(2) Notwithstanding any provisions of Kentucky Revised Statutes to the contrary, when\nthe fiscal court of any county containing a population of over two hundred thousand\n(200,000) and a city of the first class have in effect a compact under KRS 79.3 10 to\n79.330, the city and county shall by joint action create a joint city/county\ndepartment for the purpose of providing a free public library. In such event, the\nboard of trustees shall be dissolved as a corporate entity, and all assets and\nliabilities of the board of trustees shall be transferred to the joint department. An\nadvisory board may be established by joint agreement of such city and county. Upon\nthe establishment of a consolidated local government in a county where a city of the\nfirst class and a county containing that city have had in effect a cooperative compact\npursuant to KRS 79.310 to 79.330, the joint department shall become a department\nof the consolidated local government and all assets and liabilities of the joint\ndepartment shall be t ransferred to the consolidated local government. An advisory\nboard may be established or maintained by a consolidated local government.\nMembers of the advisory board shall be appointed pursuant to the provisions of\nKRS 67C.139 and shall serve at the pleasu re of the mayor of the consolidated local\ngovernment.\n(3) If the fiscal court enters into a contract pursuant to subsection (1) of this section,\nthen the county judge/executive shall have the authority to appoint one -half (1/2) of\nthe positions on the boar d of trustees of the free public library. Appointments shall\nbe made for four (4) year terms. Each appointee must be at the time of his or her\nappointment a taxpayer and qualified voter in the county.\n(4) The county judge/executive shall make the appointme nts authorized by subsection\n(3) of this section in the following manner. On March 31 of 1978 and March 31 of\n1980, he or she shall appoint persons to fill two (2) of the vacancies which occur.\nOn March 31 of 1979 and March 31 of 1981, he or she shall appo int a person to fill\none (1) vacancy which occurs. He or she shall continue to make the appointments to\nthese positions when a vacancy occurs or a term expires, subject to subsection (5) of\nthis section.\n(5) If the contract between the fiscal court and a f ree public library terminates or ceases\nto be in effect, the county judge/executive shall no longer have the authority to\nappoint persons as trustees to the board of the free public library and the mayor may\nterminate the appointment of trustees appointed by the county judge/executive and\nappoint persons to fill their unexpired terms.\n(6) The fiscal court may annually appropriate money out of the county treasury to the\nmaintenance and support of the library.\n(7) Money so appropriated by the fiscal court may be expended by the board of trustees\nof the free public library in the establishment of branch stations in the county\noutside the city of the first class, under regulations of the board of trustees.","path":["KRS Chapter 173"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=4913","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:23Z","sha256":"651df5a4790c45726b4abd5c419c864e806152f1b95ce79d6d01357a387eb6e4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-173.100","next":"us-ky/krs-173.106"},"notice":"GroundRules: Original legal text.
