{"data":{"id":"us-ky/krs-173.310","jurisdiction":"us-ky","citation":"KRS 173.310","heading":"Methods by which library service may be provided -- Appropriation or","body":"levy on establishment.\nAny governmental unit may provide library service for its inhabitants according to any\none (1) of the following methods:\n(1) The legislative body on its own initiative may establish an independent library.\n(2) Upon receipt of a petition signed by a number of taxpayers equal to five percent\n(5%) of the number of votes cast for officers in the last general election of such\ngovernmental unit, the legislative body s hall submit the question to a vote at the\nnext general election by submitting the question to the county clerk not later than\nthe second Tuesday in August preceding the general election. If a majority of those\nvoting on the question vote in favor of the pr oposition, the legislative body shall\nforthwith establish a library, except as provided in subsection (4) of this section.\n(3) The legislative bodies of two (2) or more adjacent counties may on their own\ninitiative, or upon a petition and vote in each coun ty as provided in subsection (2)\nabove, or upon the initiative of some legislative bodies and petition and vote in\nothers, join in establishing and maintaining a regional library, provided the\naggregate assessed valuation of the property assessable for loc al taxation in such\ncounties is a minimum of $10,000,000, and subject to the provisions of KRS\n173.320.\n(4) The legislative body of any governmental unit may on its own initiative contract to\nreceive service from an existing nearby library, the library of a nearby institution of\nhigher learning, the State Department for Libraries and Archives, or from a nearby\nlibrary not owned by a governmental unit but which provides free service, each of\nthese having reciprocal power to render the service. In the event o f a petition and\nvote as provided by subsection (2), a legislative body shall have the privilege of\nproviding library service by contract in lieu of establishing an independent library.\nWhen any one (1) of the above methods has been complied with, the legi slative bodies of\nthe governing units shall at once make the necessary appropriation or levy to establish\nand maintain such library service annually and perpetually.","path":["KRS Chapter 173"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=4936","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:24Z","sha256":"9621af7761d78bf86c4ece07bf1bc40955324e1532aae8e278f67afcd91d3bb8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-173.300","next":"us-ky/krs-173.320"},"notice":"GroundRules: Original legal text.
