{"data":{"id":"us-ky/krs-173.480","jurisdiction":"us-ky","citation":"KRS 173.480","heading":"Notice of organization -- Copy of petition -- Duties of Department for","body":"Libraries and Archives -- Board membership -- Appointment process.\n(1) Upon the creation of a district, the fiscal court of each county in the district shall at\nonce notify the Department for Libraries and Archives of the establishment of the\ndistrict and shall forward to the department a copy of the petition required pursuant\nto KRS 173.470. The Department for Libraries and Archives shall then recommend\nto the county judge /executive of each county in the district the names of suitable\npersons from among the signers of the petition to be appointed to the board. The\nDepartment for Libraries and Archives in recommending persons to the county\njudge/executive for appointment to the board shall recommend twice as many\npersons for each county as the county is entitled to have members appointed, and\nthe county judge/executive shall immediately, with the approval of the fiscal court,\nmake the selection from those recommended unless t he fiscal court has adopted an\nalternative appointment process through the passage of a resolution. For fiscal\ncourts that adopt an alternative appointment process, the county judge/executive:\n(a) 1. May immediately, with the approval of the fiscal court, make the\nselection from those recommended by the Department for Libraries and\nArchives; and\n2. For any appointments the county judge/executive decides not to fill from\nthe first recommendations, shall request the Department for Libraries\nand Archives to su bmit within thirty (30) days two (2) additional\nrecommended persons for each unfilled appointment, and, with the\napproval of the fiscal court, may make the selection from those\nrecommendations; and\n(b) For any remaining unfilled appointments after the prov isions of paragraph (a)\nof this subsection have been followed, shall appoint, with the approval of the\nfiscal court, individuals of his or her choosing, whether or not the individuals\nsigned the petition, no later than thirty (30) days after the day the co unty\njudge/executive received the recommendations under paragraph (a)2. of this\nsubsection and made no appointment therefrom. The county judge/executive\nshall notify the Department for Libraries and Archives of the name of any\nindividual appointed in the manner set out in this paragraph.\n(2) Where the district consists of one (1) county, the county judge/executive shall\nappoint five (5) persons from that county as members.\n(3) Where the district consists of more than one (1) county, the Department for\nLibraries and Archives shall prescribe by regulation the number of board members,\nprovided that the board shall consist of:\n(a) Not less than one (1) nor more than four (4) members from each county, each\ncounty having such number of members as the proportion of  its population\nbears to the total population in the district; and\n(b) Not less than five (5) members.\n(4) Where a county joins an already established district:\n(a) The Department for Lib raries and Archives shall, from among the signers of\nthe petition, recommend to the county judge/executive of each county\nincluded in the new district for the first time twice as many persons for\nappointment to the board as the county is entitled to have a ppointed, and the\ncounty judge/executive shall select the members for the county from this list\nunless the fiscal court has adopted an alternative appointment process through\nthe passage of a resolution. For fiscal courts that adopt an alternative\nappointment process, the county judge/executive:\n1. a. May select the members for the county from those recommended\nby the Department for Libraries and Archives; and\nb. For any appointments the county judge/executive decides not to\nfill from the first recommendati ons, shall request the Department\nfor Libraries and Archives to submit within thirty (30) days two\n(2) additional recommended persons for each unfilled\nappointment, and, with the approval of the fiscal court, may make\nthe selection from those recommendations; and\n2. For any remaining unfilled appointments after the provisions of\nsubparagraph 1. of this paragraph have been followed, shall appoint,\nwith the approval of the fiscal court, individuals of his or her choosing,\nwhether or not the individuals signed  the petition, no later than thirty\n(30) days after the day the county judge/executive received the\nrecommendations under subparagraph 1.b. of this paragraph and made\nno appointment therefrom. The county judge/executive shall notify the\nDepartment for Libr aries and Archives of the name of any individual\nappointed in the manner set out in this subparagraph; and\n(b) The terms of the members of the counties composing the previously existing\ndistrict shall expire immediately upon the organization of the new boa rd and\nsuch vacancies shall be filled as provided in KRS 173.490.","path":["KRS Chapter 173"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53351","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:24Z","sha256":"1c087a3be869767b3ae6700f352d44eff934aab3b3163832bea37b0c9c2a6f2f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-173.470","next":"us-ky/krs-173.490"},"notice":"GroundRules: Original legal text.
