{"data":{"id":"us-ky/krs-173.490","jurisdiction":"us-ky","citation":"KRS 173.490","heading":"Terms of board members -- Appointment to fill vacancies -- Removal of","body":"members -- Advisory board -- Residency requirement.\n(1) (a) One-third (1/3) of the persons first appointed to the board shall serve for a\nterm of two (2) years, one -third (1/3) for a term of three (3) years and one -\nthird (1/3) for a term of four (4) years. Where the board consists of a number\nof members not divisible by three (3), one -third (1/3) of the next higher\nnumber divisible by three (3), shall serve for a term of two (2) years, one-third\n(1/3) for a term of three (3) years, and the remaining number shall serve for a\nterm of four (4) years. Thereafter, as their terms expire, the board shall make\nrecommendations on their successors, who shall be appointed as set out  in\nparagraph (b) of this subsection.\n(b) 1. The board shall recommend two (2) persons committed to the provision\nof library services to the county judge/executive for each vacancy,\nunless the fiscal court has adopted an alternative appointment process\nthrough the passage of a resolution as set forth in subparagraph 2. of this\nparagraph. The county judge/executive shall within thirty (30) days,\nwith the approval of the fiscal court, make the selection from those\nrecommended unless the fiscal court has adopt ed an alternative\nappointment process. Within fourteen (14) days, the board shall notify\nthe Department for Libraries and Archives of the name of any person\nappointed.\n2. For fiscal courts that adopt an alternative appointment process through\nthe passage o f a resolution, the board shall recommend one (1) person\ncommitted to the provision of library services to the county\njudge/executive, who:\na. May within thirty (30) days, with the approval of the fiscal court,\nmake the selection from the person recommended by the board; or\nb. Shall, if he or she determines that the person recommended by the\nboard is unacceptable, appoint, with the approval of the fiscal\ncourt, individuals of his or her choosing no later than thirty (30)\ndays after rejecting the board's rec ommendation. The board shall\nnotify the Department for Libraries and Archives, within fourteen\n(14) days of the appointment, of the name of any individual\nappointed by the alternative appointment process.\n(c) Board members shall serve a term of four (4) ye ars each, and may serve for\ntwo (2) consecutive terms after which they shall not succeed themselves. They\nmay be reappointed no earlier than twelve (12) months following the end of\ntheir last service. The members shall hold office until their respective\nsuccessors are appointed and qualified. After absence of a trustee from four\n(4) regular monthly meetings of the board during any one (1) year of the\ntrustee's term, the trustee shall be considered to have automatically resigned\nfrom the board. An advisory board may be appointed and serve as specified in\nthe bylaws of the board of trustees.\n(2) Any vacancy occurring in the terms of office of members shall be filled for the\nunexpired term by the county judge/executive, with the approval of the fiscal court,\nby appointment on recommendation of the board of two (2) persons committed to\nthe provision  of library services and living in the county in which the vacancy\noccurred unless the fiscal court has adopted an alternative appointment process\nthrough the passage of a resolution. For fiscal courts that adopt an alternative\nappointment process, the boa rd shall recommend one (1) person committed to the\nprovision of library services and living in the county to the county judge/executive,\nwho:\n(a) May within thirty (30) days, with the approval of the fiscal court, appoint the\nperson recommended by the board; or\n(b) Shall, if he or she determines that the person recommended by the board is\nunacceptable, appoint, with the approval of the fiscal court, an individual of\nhis or her choosing no later than thirty (30) days after rejecting the board's\nrecommendation. Any person appointed in accordance with this subsection\nshall be committed to the provision of library services and living in the county\nin which the vacancy occurred. The board shall notify the Department for\nLibraries and Archives, within fourteen (14 ) days of the appointment, of the\nname of any individual appointed in the manner set out in this subsection.\n(3) A member of the board may be removed from office as provided by KRS 65.007.\n(4) Any person appointed to the board shall be committed to the pro vision of library\nservices and living in the county in which the board operates.","path":["KRS Chapter 173"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57182","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:24Z","sha256":"8429f4905bf4b715df5adb5de926f4069aa9c90c868f754ee64f42396533e6d2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-173.480","next":"us-ky/krs-173.500"},"notice":"GroundRules: Original legal text.
