{"data":{"id":"us-ky/krs-173.800","jurisdiction":"us-ky","citation":"KRS 173.800","heading":"Procedure for dissolution of district.","body":"A district may be dissolved in the following manner:\n(1) Upon filing of a duly -certified petition of fifty -one percent (51%) of the number of\nqualified voters who voted in the last general election in the district, the fiscal court\nof each county in the district shall adopt a resolution to dissolve a library district.\n(2) The petition shall be in substantially the following form: \"The following qualified\nvoters in (insert name of county or counties) favor dissolving the (insert name of\ndistrict) Public Libr ary District.\" It shall be presented to the fiscal court within\nninety (90) days after having been signed by the first petitioner.\n(3) A certified copy of the order of the fiscal court shall be filed with the county clerk.\n(4) The county clerk or clerks in  the district will thereupon remove the tax levy from\nthe tax bills of the property owners of the district and the district shall be dissolved.\n(5) A petition for dissolution will not be considered of any legal effect if, at any time\nprior to the filing of such a petition for dissolution, either:\n(a) Contractual obligations have been assumed by pertinent contracting parties in\nconnection with said subject library, which contractual obligations would be\nadversely affected by any such dissolution; or\n(b) If, as of the time of filing of such a petition for dissolution, the board of such\ndistrict shall have arranged for the financing of a library in that district\npursuant to a plan of financing involving a lease of that library to the board\nunder which lease the board is not bound for more than one (1) year at a time\nwithout exercising an annual option to renew the lease and such lease remains\neffective and has not been terminated; or\n(c) If less than three (3) years have passed since the certified copy of the or der of\nthe fiscal court ordering the levy of the tax was filed with the county clerk.\n(6) After all contractual obligations, existing prior to the time of the attempted filing of\nsuch petition for dissolution, have been satisfied, then, at such time, a pet ition for\ndissolution may be effectively filed under this section, provided that other\nprovisions of this section are complied with.","path":["KRS Chapter 173"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=4987","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:24Z","sha256":"b7743db24a28ffbf5a1c4fbc65fc501493d096554ccb38777c593883e2fe0487","source_id":"us-ky","stale":false,"prev":"us-ky/krs-173.795","next":"us-ky/krs-173.810"},"notice":"GroundRules: Original legal text.
