{"data":{"id":"us-ky/krs-174.100","jurisdiction":"us-ky","citation":"KRS 174.100","heading":"Public hearing required prior to expenditure by unit of local government","body":"of state-derived tax revenues on roads -- Effect of hearing -- Exceptions.\n(1) Before any unit of local government expends state -derived tax revenues on a state\nrural, s econdary, county road or municipal highway, road, street, or county or\nmunicipal bridge, it shall provide an opportunity to the public to provide input in a\npublic meeting for which notice has been given under KRS 61.823(2) to (4) with\nregard to the projec t and to priorities for use of tax moneys for road and bridge\npurposes.\n(2) Prior to the contemplated date of expenditure of state -derived tax revenues on a\nroad or bridge by a unit of local government, that unit of government shall include\nthe topic as a specific item on the public meeting agenda and shall allow any person\nto speak with regard to any proposed project, any project which he or she feels\nshould be built or done which has not been proposed, priorities for completion of\nprojects, and any other matter related to road or bridge projects.\n(3) The unit of local government shall not be bound by the comments and input\nprovided at the meeting but shall give due consideration to them.\n(4) No unit of local government shall begin construction on a road or  bridge project in\nwhich state-derived tax revenues are involved until the meeting as provided in this\nsection has been held.\n(5) This section shall not be construed to require a separate meeting for each project. A\nsingle meeting encompassing the entire r oad and bridge program, if all projects\nsubsequently undertaken have been identified at the meeting, shall meet the\nrequirements of this section.\n(6) The provisions of this section shall not apply to emergency repair or replacement of\nroads or bridges nece ssitated by natural or man -caused disasters nor to street\ncleaning or snow removal operations.","path":["KRS Chapter 174"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52757","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:25Z","sha256":"8a0b4ab06d310caf12fa53bef38f11ee88975e0228379b93b692c35576fb7c49","source_id":"us-ky","stale":false,"prev":"us-ky/krs-174.085","next":"us-ky/krs-174.105"},"notice":"GroundRules: Original legal text.
