{"data":{"id":"us-ky/krs-174.130","jurisdiction":"us-ky","citation":"KRS 174.130","heading":"Cabinet's duty to transmit information concerning abandonment of","body":"railroad corridors to Department of Parks and Railtrail Development Office --\nRecords and maps of railroad lines.\n(1) The Transportation Cabinet, including any agency or other unit of go vernment\nattached to the cabinet, shall immediately transmit to the Department of Parks and\nto the Commonwealth's Railtrail Development Office in the Department for Local\nGovernment any information received from a railroad or other person having an\nownership interest in a railroad corridor pertaining to a proposed or pending action\nor proceeding to obtain federal authority for the regulatory abandonment of that\nrailroad corridor.\n(2) The Transportation Cabinet shall keep a record of railroad lines in the\nCommonwealth of Kentucky, including both lines that have been abandoned\nthrough the federal government's regulatory abandonment process and those where\nany railroad property interest in the railroad corridor itself has been abandoned\nunder Kentucky law. The cabinet shall annually publish an updated map showing\nthe location and as much information as to the status of these lines as practicable.\nThe record shall include, inasmuch as possible:\n(a) A description of the line and its location;\n(b) The current or last railroad owner of the line;\n(c) The operator of the line;\n(d) The addresses and phone numbers for the owners and operators of the lines;\n(e) Whether the owner of the line has received authority from the Federal\nGovernment to discontinue service over the line;\n(f) Whether the owner of the line has received authority from the Federal\nGovernment to abandon the line;\n(g) Whether the owner of the line has consummated any authority granted by the\nFederal Government to discontinue service over the line or to ab andon the\nline;\n(h) Whether the line has been railbanked under either federal or state law; and\n(i) Any other information the cabinet deems pertinent and useful to the public.","path":["KRS Chapter 174"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5016","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:25Z","sha256":"5ec248c34cbbdac06656623a5952f07e6479e11a4de3e09ff69f80088733f6e8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-174.125","next":"us-ky/krs-174.135"},"notice":"GroundRules: Original legal text.
