{"data":{"id":"us-ky/krs-174.210","jurisdiction":"us-ky","citation":"KRS 174.210","heading":"Riverport financial assistance trust fund -- Contributions -- Purpose --","body":"Grants -- Annual report.\n(1) There is created a riverport financial assistance trust fund, to be administered by the\nTransportation Cabinet.\n(2) The riverport financial assistanc e trust fund may receive appropriations, federal\nfunds, contributions, gifts, and donations.\n(3) The purpose of the riverport financial assistance trust fund shall be to improve\nriverport facilities and infrastructure, to capture the economic and trade pot ential\noffered by water transportation. To the extent funds are available, the fund shall\nmake grants to riverport authorities for new construction and major replacement or\nrepair projects, including but not limited to improvement of docks, wharves,\nequipment, port buildings, storage facilities, roads and railroads to facilitate the\nflow of commerce through the port, other on -site improvements, and related\nprofessional services. Eligible projects shall not include routine operations,\nmaintenance, or repair activities.\n(4) Notwithstanding KRS 45.229, moneys remaining in the fund at the close of a fiscal\nyear shall not lapse but shall carry forward into the succeeding fiscal year. Interest\nearned on any moneys in the fund shall accrue to the fund. Amounts from  the fund\nshall be disbursed and expended in accordance with this section.\n(5) To be eligible for a grant under this section, the applicant shall provide at least a\ntwenty percent (20%) match, which may be obtained from any public or private\nsource.\n(6) (a) Grant applications shall be reviewed and awarded annually.\n(b) The Transportation Cabinet shall submit all applications to the Water\nTransportation Advisory Board established by KRS 174.200 for evaluation\nand recommendations prior to awarding any grant funding under this section.\n(c) Priority shall be given to applicants with a riverport master plan, for capital -\nintensive projects for which permits have been obtained, and for projects for\nwhich matching funds have been obtained.\n(7) The Transportation Cab inet shall submit on an annual basis a report detailing all\ngrants awarded under this section to the Water Transportation Advisory Board, the\nInterim Joint Committee on Transportation, and the Interim Joint Committee on\nAppropriations and Revenue.","path":["KRS Chapter 174"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5020","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:25Z","sha256":"5eb3a231fa5bc2b288db3bf90115dea5595628f24d0649ba49e021963cb7f468","source_id":"us-ky","stale":false,"prev":"us-ky/krs-174.205","next":"us-ky/krs-174.400"},"notice":"GroundRules: Original legal text.
