{"data":{"id":"us-ky/krs-174.405","jurisdiction":"us-ky","citation":"KRS 174.405","heading":"Definitions.","body":"As used in KRS 174.400 to 174.425:\n(1) \"Carrier\" means a person engaged in the commercial transportation of passengers or\nproperty, except for pipelines and railways, by:\n(a) Land, as a common, contract, or private carrier; or\n(b) Civil aircraft.\n(2) \"Hazardous material\" means a substance desig nated hazardous by the Federal\nHazardous Materials Transportation Law (49 U.S.C. sec. 5101 et seq.) and\nregulations issued pursuant thereto, including but not limited to hazardous and\nradioactive waste, but shall not include agricultural wastes, coal minin g wastes,\nutility waste (fly ash, bottom ash, scrubber sludge), sludge from water treatment and\nsewage treatment facilities, cement kiln dust, gas and oil drilling muds, oil\nproduction brines or waste oil.\n(3) \"Hazardous waste\" means a substance or materia l defined as hazardous waste by\nKRS Chapter 224 and regulations issued pursuant thereto.\n(4) \"Radioactive material\" means any material or combination of material, which\nspontaneously emits ionizing radiation. Materials in which the estimated specific\nactivity is not greater than 0.002 microcuries per gram of material, and in which the\nradioactivity is essentially uniformly distributed, are not considered to be\nradioactive materials.\n(5) \"Radioactive waste\" means any waste substance or combination of substan ces, in\nany form which because of its radioactive material content may create a threat to\npublic health or to animal, plant, and aquatic life forms.\n(6) \"Vehicle\" means any device or contrivance for carrying or conveying persons,\nproperty, or substances, including conveyance by highways or by airway.","path":["KRS Chapter 174"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5022","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:25Z","sha256":"0720a3797720a1976bae7912ccaf90aeb89afcb36700ba8dbfe71b25101c498b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-174.400","next":"us-ky/krs-174.410"},"notice":"GroundRules: Original legal text.
