{"data":{"id":"us-ky/krs-175.580","jurisdiction":"us-ky","citation":"KRS 175.580","heading":"Maintenance of turnpike -- Restoration of private property -- Donation of","body":"property by county or city -- Annual report of turnpike activities -- Audits --\nProhibition of interest of department or authority personnel.\n(1) Except as otherwise provided in  the agreement or lease relating thereto, each\nturnpike project when constructed and opened to traffic shall be maintained and\nkept in good condition and repair by the department under the terms and provisions\nof the agreement or lease, and shall be operat ed and maintained by such force of\ntolltakers, and other operating and maintenance employees, as the department may\nin its discretion employ, and the department shall not be reimbursed for the cost\nthereof unless expressly otherwise provided in the agreement or lease.\n(2) All private property damaged or destroyed in carrying out the powers granted by\nthis chapter shall be restored or repaired and placed in its original condition as\nnearly as practicable or adequate compensation made therefor out of funds provided\nunder the authority of this chapter.\n(3) All counties, cities, towns and other political subdivisions and all public agencies\nand commissions of the Commonwealth, notwithstanding any contrary provision of\nlaw, may lease, lend, grant or convey to the authority at its request, upon such terms\nand conditions as the proper authorities of the counties, cities, towns, political\nsubdivisions, agencies or commissions of the Commonwealth deem reasonable and\nfair and without the necessity for any advertisement , order of court or other action\nor formality, other than the regular and formal action of the authorities concerned,\nany real property which is necessary or convenient to the effectuation of the\nauthorized purposes of the authority, including public roads  and other real property\nalready devoted to public use.\n(4) On or before January 30 in each year the authority shall make an annual report of its\nactivities for the preceding year to the Governor and to the General Assembly. Each\nsuch report shall set fort h a complete operating and financial statement covering its\noperations during the year. The authority shall cause an audit of its books and\naccounts to be made at least once in each year by certified public accountants and\nthe cost thereof may be treated a s a part of the cost of construction or operation of\nthe project. Such audits are public records within meaning of KRS 61.870(2).\n(5) No officer or employee of the authority or of the department shall have any interest,\ndirect or indirect, in the sale or p urchase of any bonds authorized by this chapter.\nViolation of this provision shall be punishable by a fine of not more than one\nthousand dollars ($1,000) or by imprisonment for not more than one (1) year, or\nboth.","path":["KRS Chapter 175"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=5090","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:25Z","sha256":"5807b02b166e960c563b85c936887dbd3278aa968a7a5079ca154e627cdf3aa5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-175.570","next":"us-ky/krs-175.590"},"notice":"GroundRules: Original legal text.
